BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30 -28 -101(10)(a) -
(d) as amended, and the Subdivision Regulations of Garfield
County, Colorado, adopted April 23, 1984 Section 2:20.49,
the undersigned Susan G. Mackie, individually, and as
Trustee, respectfully petition the Board of County Commis-
sioners of Garfield County, Colorado, to exempt by
Resolution the division of a 56.49 acre tract of land into
three tracts of 22.94, 21.44 and 12.11 acres, from the
definitions of "subdivision" and "subdivided land" as the
terms are used and defined in C.R.S. (1973) Section
30 -28 -101(10)(a) -(d) and the Garfield County Subdivision
Regulations for the reasons stated below:
The area in the neighborhood of the tract has been
subdivided into tracts, generally smaller than the 56.49
acre size of this tract. The tract is too large for
disposal for a single family dwelling, but can be divided so
that it will provide three good residential sites. The
owners of the property at the Northeast corner have already
agreed to purchase the 22.94 acres of Lot C to include with
their present 5 acre tract, eliminating any requirement for
water or other services for that tract of land. Since her
husband passed away, applicant has not lived in the area.
She wishes to dispose of the entire acreage but has been
unable to sell the tract as a whole. The applicant cannot
realize anything from the property without dividing it into
the smaller tracts, and the applicant does not believe that
any of the surrounding land owners will have any objection
to the division. In connection with this submittal the
applicant would show the Board as follows:
A. There is attached hereto as Exhibit A a
surveyor's blue line plat of the property showing the legal
description thereof, and the dimensions and area of the lots
or parcels to be created if this application is granted.
All parcels will have access to a public right of way.
B. A vicinity map taken from the U.S.G.S. quadrangle
is attached as Exhibit B.
C. Copies of two deeds showing ownership in the
applicant are attached as Exhibit Cl and C2.

D. The names and addresses of owners of record of
the land taken from the records in the office of the County
Assessor adjoining and within 200 feet of the proposed
exemptions, are attached as Exhibit D.
E. Attached as Exhibit E is the Soil Conservation
Map of the property, and information obtained from them
concerning the soil types and characteristics. Except for a
small portion of less than 1 acre all of the tract is
suitable for homesites.
F. Attached as Exhibit F is a copy of the well
permit issued by the Office of the State Engineer. Since
parcel C will not require separate water service, the water
well will be located on the property line between proposed
Lots A and B.
G. Tax receipts for 1984 are attached as Exhibit G.
H. The Chief of the Carbondale and Rural Fire
Department will shortly advise the County Planning
Department of their views.

On the recommendation of the Garfield County Planning
Department, you very kindly consented to an S.B. 35
exemption for Susan B. Mackie conditioned on requirements
from the Planning Department for completion. One of those
conditions was to obtain an affidavit to accompany a
conveyance to Mrs. Mackie of a small strip of land which
lies on the north side of Parcel No. B on the plat prepared
for the property and which cuts off that Parcel B from
County Road 103. We have not as yet been able to obtain
signature on the quit claim deed and the affidavit, but
expect to have this problem cleared in the next few weeks.
Thereafter we will have prepared a modified plat and file
with the same with the Planning Commission.
Accordingly, you are requested to extend the time for
compliance with the resolution from the previously
established 120 days for an additional 90 days to allow us
to complete all requirements.

This letter is to update you on the pending status of the Mackie SB 35
Exemption and what conditions remain to be completed:
1. The Planning Department has received a completed copy of the
Boundary Line Adjustment Affidavit for the conveyance of the
22.94 acre parcel which was identified as Lot C on the original
application. Recording of the affidavit with the Clerk and
Recorder's Office is required and is the responsibility of the
applicant.
2. A Boundary Line Adjustment Affidavit for the conveyance to Susan
Mackie of that strip of land between County Road 103 and the
north property line of Lot B is also required. This affidavit is
needed to establish legal access for Lot B, in light of
complication regarding the historical access point. The
affidavit must be recorded and include legal descriptions for the
property involved. A copy of the affidavit form is enclosed.
3. A modified plat, showing the new property line of Lot B along
County Road 103, needs to be submitted.
4. The Plat should also include the Plat note, "All irrigation
ditches and ditch easements are to be recognized and maintained
as existing and in place, in the usual manner".
According to our records, these items are all that remain to be completed
prior to final approval of the exemption. Please contact this office, if

106--Tridell-Brownsto moderately stony sandy loams, 12 to 50 percent
slopes. This map unit is on terrace and mountainside slopes. Elevation
is 6,400 to 7,700 feet. The average annual precipitation is 12 to 14
inches, the average annual air temperature is 42 to 44 degrees F, and the
average frost -free period is 85 to 105 days. The native vegetation is
mainly small conifer trees, woody shrubs, grasses, and forbs.
This unit is 45 percent Tridell and 35 percent Brownsto. The surface
is scattered with 5 to 10 percent stones. The components of this unit are
so intricately intermingled that it was not practical to map them separately
at the scale used.
Included in this unit are small areas of Forelle and Evanston soils in
less sloping areas of clearings. Also included are small areas of basaltic
Rock outcrop and soils that are similar to this Tridell soil but have less
gravel and stones. Included areas make up about 20 percent of the total
acreage.
• The Tridell soil is deep and somewhat excessively drained. It formed
in alluvium and colluvium derived dominantly from sandstone and basalt.
Typically, the upper part of the surface layer is grayish brown moderate
stony sandy loam about 2 inches thick. The lower part is grayish brown very
cobbly fine sandy loam 7 inches thick. The upper 5 inches of the underlying
material is very cobbly fine sandy loam. The next layer is cobbly sandy
loam 11 inches thick. The next 12 inches is very stony fine sandy loam.
The lower part to a depth of 60 inches is very stony loamy sand. Hard
basalt is common below -60 inches. The soil is calcareous throughout the
profile. A thin .layer of partially decomposed needles, twigs, and leaves is
on the surface in many places.

Permeability of the Tridell soil is moderately rapid. Available water
capacity is low. Effective rooting depth is 20 to 40 inches. Runoff is
rapid, and the hazard of water erosion is very high.
The Brownsto soil is deep and well drained. It formed in alluvium
derived dominantly from coarse textured calcareous sandstone and basalt.
Typically, the upper part of the surface layer is light brownish gray
moderately stony sandy loam 11 inches thick. The upper 19 inches of the
underlying material is very gravelly sandy loam. The next 12 inches if very
gravelly loamy sand. The lower part to a depth of 60 inches is gravelly
sandy loam. A thin layer of partially decomposed needles, twigs, and leaves
is on the surface in many places.
Permeability of the Brownsto soil is moderately rapid. Available water
capacity is low. Effective rooting depth is 20 to 40 inches. Runoff is
moderately rapid, and the hazard of water erosion is very high.
This unit is used mainly for livestock grazing and wildlife habitat.
It is also used for firewood, posts, Christmas trees, and limited homesite
development.
The potential plant community on the Tridell soil is mainly pinyon pine
and Utah juniper with an understory of bluebunch wheatgrass, Indian
ricegrass, Wyoming big sagebrush, and muttongrass. The potential plant
community on the Brownsto soil is is mainly Wyoming big sagebrush,
needelandthread, Indian ricegrass, western wheatgrass, and scattered pinyon
pine and Utah juniper. Other vegetation commonly present in the potential
plant community on these soils included bottlebrush squirreltail, antelope
bitterbrush, and true mountainmahogany. The average annual production of
native understory vegetation on the Tridell soil is about 300 pounds of
air-dry vegetation per acre. The average annual production of air-dry
vegetation on the Brownsto soil is about 600 pounds per acre.

If the range condition deteriorates, Wyoming big sagebrush, cheatgrass,
and annual weeds increase. Management practices suitable for use on this
unit are proper grazing use and a planned grazing system. Slope limits
access by livestock and results in overgrazing of the less sloping areas.
Mechanical treatment is not practical, because the surface is very stony and
the slopes are steep. Selective thinning of the pinyon and juniper improves
the quality of the understory for grazing and provides firewood, posts, and
Christmas trees.
The Tridell soil is suited to limited production of pinyon pine and
Utah juniper. The average annual production is 5 cords per acre. The aver-
age stocking rate is 150 trees per acre. To insure sustained yields and
continued use, the kind of wood production should be considered before using
management practices such as thinning and clearing. Special care is needed
to minimize erosion when thinning and clearing. Thinning generally promotes
the growth of understory grasses and young trees.
Only less sloping areas of this unit are suited to homesite, develop-
ment. If this unit is used for homesite development, the main limitations
are slope and stones in the soil. Erosion is a hazard in the steeper areas.
Only the part of the site that is used for construction should be disturbed.
Topsoil can be stockpiled and used to reclaim areas disturbed during con-
struction. Removal of gravel and cobbles in disturbed areas is needed for
best results when landscaping, particularly in areas used for lawns. Areas
in this unit adjacent to hillsides are occasionally affected by runoff,
which may also be accompanied by movement of rock debris. Population growth
has resulted in increasedconstruction of homes on this unit.
This map unit is in capability subclass VIIe, nonirrigated. The
Tridell soil is in Pinyon -Juniper Woodland site and the Brownsto soil is in
Stony Foothills range site.

95--Showalter—Morval complex, 15 to 25 percent slopes. This map
unit is on alluvial fans, high terraces and valley sides. Elevation is
7,000 to 8,500 feet. The average annual precipitation is 14 to 16 inches,
the average annual air temperature is 42 to 44 degrees F, and the average
frost—free period is 80 to 90 days.
This unit is 45 percent Showalter very stony loam and 35 percent Morval
loam. the components of this unit are so intricately intermingled that it
was not practical to map them separately at the scale used. The Showalter
soils occupy convex parts of the landscape and Morval soils are in more
concave positons.
Included in this unit are small areas of soils similar to this Morval
soil which have 30 to 50 percent cobble in the substratum. Included areas
make up about 20 percent of the total acreage.
The Showalter soil is deep and well drained. It formed in alluvium
derived dominantly from basalt. Typically, the surface is covered with 10
to 15 percent stones, 5 percent cobble, and 5 percent gravel.
The surface layer is brown very stony loam 8 inches thick. The upper 3
inches of the subsoil is very cobbly clay loam. The lower 28 inches of the
subsoil is very cobbly clay. The substratum to a depth of 60 inches or more
is very cobbly clay loam.
Permeability of the Showalter soil is slow. Available water capacity
is high. Effective rooting depth is 60 inches or more.• Runoff is medium,
and the hazard of water erosion is moderate.

The Morval soil is deep and well drained. It formed in alluvim derived
dominantly from basalt. The surface layer is brown loam 7 inches thick.
The upper 12 inches of the subsoil is clay loam. The lower 3 inches is
loam. The underlying material to a depth of 60 inches is loam. The soil is
noncalcareous to a depth of 19 to 35 inches and calcareous below that
depth.
Permeability of the Morval soil is moderate. Available water capacity
is moderate. Effective rooting depth is 60 inches or more. Runoff is
medium, and the hazard of water erosion is slight.
This unit is used for rangeland, hayland, and homesite development.
The potential plant community on the Showalter soil is mainly bluebunch
wheatgrass, western wheatgrass, prairie junegrass, Indian ricegrass, true
mountainmahogany, antelope hitterhrush, Saskatoon serviceberry, and big
sagebrush. The average annual production of air-dry vegetation is about 900
pounds per acre. The potential plant community on the Morval soil is mainly
needleandthread, western wheatgrass, muttongrass, praire junegrass, and big
sagebrush. The average annual production of air-dry vegetation is about
1,500 pounds per acre.
If this unit is used for rangeland seeding or mechanical treatment, the
main limitation is stones on the surface of the Showalter component.
Management practices suitable for use on this soil are proper range use,
deferred grazing, rotation grazing, and aerial spraying for brush
management.
If this unit is used for hay and pasture, the main limitations are
stones on the surface, steep slopes, and slow permeability of the Showalter
soil. Grasses and legumes grow well if adequate fertilizer is used.

This unit is very poorly suited to homesite development. The main
limitations are slope, shrink -swell and stones throughout the profile.
This map unit is capability subclass VIe, nonirrigated. The Showalter

soil is in Loamy Slopes range site and the Morval soil is in 8vae

areas of alluvium and eolian material. Elevation is 6,500 to 9,000 feet.

temperature is 40 to 44 degrees F, and the average frost -free period is 75 to
95 days.
The surface layer is brown loam 5 inches thick. The subsoil is clay loam
35 inches thick. The substratum to a depth of 60 inches or more is clay
loam. The soil is noncalcareous to a depth of 40 inches and calcareous below
that depth.
Included in this unit are small areas of similar soils with darker,
thicker surface layers. Also included are small areas of similar soils with
silt loam and silty clay loam textures. Included areas make up about 20
percent of the total acreage.
Permeability of the Empedrado soil is moderate. Available water capacity
is high. Effective rooting depth is 60 inches or more. Runoff is medium,
and the hazard of water erosion is slight.
This unit is used for hayland and cropland.
This unit is well suited to hay and pasture. Grasses and legumes grow
well if adequate fertilizer is used. If properly managed, this unit can
produce 5 tons of irrigated grass hay per acre.

wheatgrass, needleandthread, prairie junegrass, mountain big sagebrush and
Douglas rabbitbrush. Other less numerous plants that characterize this site
are muttongrass, western wheatgrass, Letterman needlegrass, common
snowberry, Utah serviceberry and antelope bitter brush. The average annual
production of air-dry vegetation is about 1,500 pounds per acre. If the
range condition deteriorates, mountain big sagebrush, Kentucky bluegrass,
Douglas rabbitbrush and annual weeds increase.
This unit is well suited to alfalfa and small grains crops. It has few
limitations. Maintaining crop residue on or near the surface reduces runoff,
reduces soil blowing, and helps to maintain soil tilth and organic matter
content. If properly managed, this unit can produce 90 bushels of barely per
acre.
This map unit is suited to homesite development. Shrink -swell potential
can be minimized by thoroughly prewetting foundation areas. The limitations
of moderate permability can be overcome by increasing the size of the
absoption field.
Capability subclasses IVe, irrigated, and IVe nonirrigated. It is in
Deep Loam range site.

medium, and the hazard of water erosion is moderate.
This unit is used for hayland and cropland.
This unit is well suited to hay and pasture. Grasses and legumes grow

produce 4 tons of irrigated grass hay per acre.
This unit is well suited to alfalfa and small grains crops. It is
limited mainly by steeper slopes in some areas. Limiting tillage for
seedbed preparation and weed control reduces runoff and erosion. All
tillage should be not the contour or across the slope. If properly managed,
this unit can produce 75 bushels of barley per acre.

The potential plant community on this unit is mainly bluehunch
wheatgrass, needleandthread, prairie junegrass, mountain big sagebrush, and
Douglas rabbitbrush.
Other less numerous plants that characterize this site are muttongrass,
western wheatgrass, Letterman needlegrass, common snowberry, Utah
serviceberry, and antelope bitterbrush. The average annual production of
air-dry vegetation is about 1,500 pounds per acre. If the range condition
deteriorates mountain big sagebrush, Kentucky bluegrass, Douglas
rabbitbrush and annual weeds increase. These plants are dominant when the
range is in poor conditon; therefore, grazing should be managed so that the
desired balance of species is maintained in the plant community.
This map unit is suited to homesite development. The main limitations
are shrink -swell potential and slope. Shrink -swell potential can be
minimized by preweting foundation areas. The steepness of slope is a
concern in installing septic tank absorption fields. Absorption lines
should be installed on the contour.
Capability units IVe, irrigated, and IVe nonirrigated. It is in Deep
Loam range site.

November 12, 1985
Connnissioner Schmeuser made a motion that the Public Hearing be closed.
Commissioner Cerise seconded the motion; carried. Decision was deferred until
the adoption of the rest of the budget resolutions in the afternoon.
SENATE BILL EXEMPTION REQUEST LOCATED APPROXIMATELY 4 1/2 MILES NORTHEAST OF
CARBONDALE OFF COUNTY ROAD 103; APPLICANT, SUSAN MACKIE.
Don stated that all notice provisions appeared to have been complied with and
the applicant's attorney, Kenneth Balcomb testified to the proper posting of
the property. Mr. Balcomb and County Planner Glenn Hartmann discussed the
notice to adjacent land owners within 200 feet and Commissioner Cerise made a
motion that the Board accept these notice as adequate to proceed with the
hearing. Couudssioner Schmeuser seconded the motion; carried. Glenn
suuunarized the staff report and Commissioner Cerise made a motion that the
Senate Bill Exemption Requested by Susan Mackie be approved with the following
conditions:
1 That the following plat notes be included on the exemption plat.
a) No further divisions by exemption from definition of subdivision
will be allowed.
b) That all irrigation ditch easements be recognized and maintained
as existing and in place.
2. That all parcels receive a deeded interest in the existing well
consisting of a minimum of 5 gpm, and that easements for all
waterlines, and for access and maintenance of the well be included on
the exemption plat and in any legal descriptions.
3. That all shares of irrigation water associated with the property be
divided proportionately amongst the three lots.
4. That $200.00 per lot in School Impact fees for the creation of each
new lot be paid prior to final approval.
5. All representations of the applicant, either with the application or
stated at the hearing before the Board of County Commissioners, shall
be considered conditions of approval.
Commissioner Schmueser further moved that the approval be contingent upon a
boundary line adjustment should the applicant create only one new lot.
Couuuissioner Cerise seconded the notion; carried.
PUBLIC HEARING REGARDING A SPECIAL USE PERMIT FOR A NATURAL GAS PIPELINE AND
COMPRESSOR STATION LOCATED BETWEEN PARACHUTE AND RIFLE IN THE VICINITY OF
COUNTY ROAD 215, I-70 AND THE COLORADO RIVER; APPLICANT, BARRETT ENERGY
COMPANY.
Sworn in were Frank Keller, Vice -President of Barrett Energy Co., 1125 17th
St., Denver; J. N. Burkhalter of Burkhalter Engineering, 715 Horizon Drive,
Grand Junction; and County Planner Glenn Hartmann. Don stated that all notice
requirements appeared to have been complied with and discussed the compliance
with the county regulation that requires applicants to be the owners of the
subject property in the application or authorized by the owners of the property
to make application. Upon questioning, Mr. Burkhalter stated that the property
the pipeline would go through is owned by various people. Mr. Keller stated
that Barrett Energy plans to buy the land for the compressor station from Mobil
and agrees to comply with the Planning Department's recommended condition that
they acquire proper right-of-ways and easements. Mr. Keller stated that
Barrett Energy would represent to the landowners involved in the right of ways
and easements that they, as landowners, are subject the conditions of the
Special Use permit and the authority of the county regulations and further
stated that all of the subject landowners have been notified of this Public
Hearing regarding their land. The letter to the landowners was reviewed and it
was determined by the Board that the hearing could proceed on the basis that
Mr. Keller and Mr. Burkhalter are authorized to represent the landowner
interests in the permit process.
Glenn Hartmann presented the following exhibits: A) Application, B) Proof of
publication from the Glenwood Post, C) Return mail receipts, D) Staff report,
and E) Map of subject property. The exhibits were admitted into the record.
Glenn summarized the staff comments and a correction was made in condition No.
2 replacing the word, "driller" with, "contractor and subcontractor".
Commissioner Cerise made a motion that the Public Hearing be closed.
Commissioner Schmueser seconded the motion; carried. Commissioner Cerise made
a motion that the Special Use permit for a natural gas pipeline and compressor
station requested by Barrett Energy Company be approved with the following
conditions:
1. All proposals of the applicant shall be considered conditions of
approval unless stated otherwise by the Board.

6 Mark Bean summarized the staff comments and after discussion regarding sewer
7 and water systems'limitation and the agreement between the homeowner's
8 association and the partnership, Commissioner Richardson made a motion that the
9 public hearing be closed. Commissioner Cerise seconded the motion; carried.
10 Commissioner Richardson made a motion that the Board approve the Re -division of
11 Parcel 2, Phase II"and "D" units Final Plat of Ranch at Roaring Fork, applicant
12 Down Valley Partnership. Commissioner Cerise seconded the motion; carried.
13 Commissioner Cerise made a motion that the Chairman be authorized to sign
14 Resolution No. 86-46 concerned with granting an exemption from the Garfield
15 County Subdivision Regulations for Susan G. Mackie and that the Chairman also
16 be authorized to sign the plat for the Mackie exemption. Commissioner
17 Richardson seconded the motion; carried.
18 Dan Kerst discussed the possibility of J. Stinecipher & Co. be allowed to
19 dispose of wood and fiberglass materials from his staging area into the county
20 dump. After discussion, the Board denied the request on the basis that prior
21 to bidding for the job, a resolution had been passed that no materials would be
22 accepted in the landfill. They suggested that the wood could be burned with a
23 permit.
24 There was considerable discussion with Roger and Don DeFord regarding the
25 choices of self insurance proposals. The Board decided to defer a decision
26 until next week.
27 Roger Ludwig presented his letter of resignation stating that he was offered
28 and was accepting a ministry position in his church and was giving a seven -week
29 notice. There was considerable discussion regarding projects which were in
30 process and needed to be completed. A Resolution with a job description for
31 County Administrator was reviewed and method and place of advertising for the
32 position, qualification and salary range were discussed. Commissioner Cerise
33 made a motion that the Board adopt the resolution establising the duties of the
34 of County Administrator. Commissioner Richardson seconded the motion;
35 carried. The Board directed that the resolution be signed next week or when an
36 administrator was hired.
37 The next item on the agenda was a discussion with Dr. Mary Jo Jacobs regarding
38 the,pros and cons of forming a Health Department. Dr. Jacobs believed that a
39 Health Department could get more accomplished and provide a better budget.
40 Commissioner Richardson felt that the problems within the current system would
41 not be solved by the additional bureaucracy of a Health Department. After
42 considerable discussion, Commissioner Richardson made a motion that:a Health
43 Department not be set up and that the current Board of Health be continued.
44 Chairman Schmueser stepped down to second the motion; carried with a vote of 2
45 to 1; Commissioner Cerise voting, "Nay" and Commissioner Richardson and
46 Chairman Schmueser voting, "Aye". Roger was directed to write a letter to the
47 Colorado Department of Health informing them of this decision. Dr. Jacobs was
48 directed to meet with Attorney Don DeFord to review the jobs she is doing to
49 see if any of them are outside the scope of what the statutes say the county
50 should be providing and what the liability is in these cases.
51 The next item on the agenda was with Planning of New Institutions (PONT): Jail
52 Workshop I which was a discussion with Bob Deichman from Champagne, Illinois of
53 the National Institute of Corrections in Boulder, CO. Mr. Deichman discussed
54 the PONI responsibility of providing guidelines and statistics which would
55 assist municipalgovernments in making decisions as to what kind of
56 correctional facilities were needed. This was an informative workshop and no
57 decisions or direction's were made.
58 Roger stated that the town and city recreation directors (that were present at
59 the meeting with the Board) have made a decision in favor of the formula for
60 all future funding, to be awarded for recreation, only on the basis of vicinity
61 population and that Parachute should be treated as an equal because
62 Conservation Trust Funds received by them were for capital improvements and the
63 county funds are for recreation services. Commissioner Richardson made a
64 motion that the policy of recreation funding be on a vicinity population basis
65 according to the state demographer and county commissioners with no other
66 qualifying factors. Commissioner Cerise seconded the motion; carried.
