PROJECT NAME: APPLICANT/OWNER: LOCATION: PROJECT INFORMATION AND STAFF COMMENTS Senate Bill 35 Exemption Request Donald and Louise Magruder 3 miles northwest of Silt on County Road 250 (see map #1, page 6) PURPOSE: To split 40 acres into two 9.1 acres, one 10 acre and one 11.9 acre tracts QUALIFICATION: Owned five + years ZONING: A/R/RD WATER: The existing house on the 10 acre parcel is served by an existing domestic well. The applicant has applied for one additional domestic well. (See major issues and concerns #5.) SEWER: Currently one (1) septic system with leach field exists and individual septic systems are proposed for the three (3) new lots ACCESS: Private access from County Road 250 I. COMPREHENSIVE PLAN: The parcel lies within District A; urban area of influence of Silt, Colorado. II. MAJOR ISSUES AND CONCERNS: 1. The parcel lies within Peach Valley Orchards, a subdivision platted in 1909 which divided the 40 acres into four 10 acre lots. (See map #2, page 7) a. The Division of Water Resources indicated that two domestic wells numbered 7368 and 38803 were issued somewhere on the 40 acre parcel in 1960 and 1969, respectively. b. The Division of Water Resources generally issues well permits for household use only on lots that were created prior to 1972. 2. The County regulations require that any adjustment of property boundaries or replatting of a platted subdivision must proceed through the full subdivision review process. 3. If the Board recognizes Peach Valley Orchards as a platted subdivision that should go through replatting and the full subdivision review process then the Division of Water Resources would like to retain the option to further review the request prior to making any committments. 4. The applicant was made aware that the County regulations require a full subdivision review in cases where subdivisions are to be replatted or where subdivision boundaries are to be adjusted. However, the applicant still wishes to continue with the exemption process. If the Board should approve the exemption request as an adjustment of property boundaries then the following items should be addressed at a minimum: X. The $400.00 school assessment fee should be submitted prior to signing the exemption resolution. b. Approval by the Division of Water Resources shall be obtained for either one additional domestic well permit or three household use only permits prior to signing the exemption resolution. 5. The Division of Water Resources feels that if approval is given by the Board of County Commissioners for an adjustment of property boundaries then they will more than likely issue the well permits for household use only.
