RESOLUTION NO. 2001-90
A RESOLUTION CONCERNED WITH GRA}ITING AN HGMPTION FROM ftM GARFIELD
COUNTY SUBDTVISION RECULATIONS FORT}IE KELLY AND MICHAEL LYON FAMILY, LLC
WHEREAS, THE KELLY AI{D MICHAEL LYON FAIVIILY, LLC, has petitioned the Board of
County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms
nsuMivision" and "subdivided land" under CjR.S. L973,30-28-101 (10) (a)-(d), as ame,nded, and the
Subdivision Regulations of Garfield County, Colorado, adopted April}3,1984, Section 8:00 through 8:60
andforthedivisionofa6S+/- acretactasdescribedinBookl24?atPagegl2,Reception#s7$7ZzasfiIed
in the Offices of the Cterk and Recorder of Garfield County, Colorado, into five (5) tacts of approximarely
3.663,3.289, and 2.822,3.024, and 54.879 acres each with the exemption parcels more practically as
follows:

(inthe State of Colorado and the Corrnty of Garfield); and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of
Part l, Article 2E, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the division

does not wartant fur0rer subdivision review; and
WHEREAS, the Petitioner has demonsrated to the satisfaction of the Board of Corurty
Commissioners of Garfield County, Colorado, that there is a rpasonable probability of locating domestic
water on each of said parcels, that there is existing ingress and egress to said parcels, that the location of
septic tanks will be permitted by the Colorado Departrnent of Health, that the requested division is not part
of an existing or larger development and does not fall within the general purposes and intelrt of the
Subdivision Regulations of the State of Colorado and the County of Garfield, and should, therefore, be
exempted from the definition of the terms "suMivisiono aod "subdivided land" as set forth in C.RS. 1973,
30-28-l0l (10) (a!(d), as amended; and
NOW THEREFORE, BE IT RESOLVEDthatthe division of the abovedescribed6S+/- acreparcel
is here,by'oreppred from such definitions and rnay be conveyed in the form of Lot l, Lot 2, L,ot 3, l,ot 4, and
[ii! 5,"$ arc mbte fully described above, and that a copy of the instnrment or instruments of conveyance
when recorded shall.be filed with this Resolution.
