HomeMy WebLinkAbout2.0 BOCC Staff Report 04.14.1986• • • • BOCC 4/14/86 PROJECT INFORMATION AND STAFF COMMENTS REQUEST: Exemption from the Definition of Subdivision OWNER: Gisella Fiou Meyers PLANNER: Gary Berschauer, Landmark Services LOCATION: A parcel located in the SE 1/4 SW 1/4, SW 1/4 SE 1/4, Section 6 and Lots 1, 2, and 3 of Section 7, T6S, R91W of the 6th P.M., located approximately 2 1/2 miles east of Silt off of the I-70 frontage road. SITE DATA: The site consists of 57.4 acres. WATER: Proposed individual wells. SEWER: Proposed individual sewage disposal systems. ACCESS: Existing access off I-70 frontage road. EXISTING ZONING: A/I, Agricultural Industrial ADJACENT ZONING: A/I, A/R/RD, and O/S I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located mainly in Districts C and D, Rural Areas with Minor and Moderate Environmental Constraints, with a small portion of the tract in District F, River Floodplain with Severe Environmental Constraints, all as designated on the Garfield County Comprehensive Plan Management Districts Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site lies between the frontage road and the Colorado River, South of I-70. The majority of the site is fairly level irrigated fields, with a single small dwelling located on the proposed 30 acre parcel. B. Project Description: The applicant proposes to divide the 57.4 acre tract into 3 parcels of 30 acres, 20 acres and 7.4 acres. C. History: The Meyers property is the only lot that has been created out of a larger original parcel since January 1973. An exemption for Michael Short was proposed and conditionally approved on the site, but was withdrawn when the property was sold as a single greater than 35 acre lot to Mrs. Meyers. III.MAJOR ISSUES AND CONCERNS A. Review Agency Comments: The Silt New Castle Fire District has been contacted but no comments have been received at this time. (, ,n.. P it` r Jo.c4,,,,v.-4 • • • • B. Staff Comments: 1. Soils information on the site indicate slight to moderate constraints to development. Comments by the Garfield County Environmental Health office on the previous application in this area indicated that professionally engineered individual sewage disposal systems may be required due to proximity to the Colorado River. 2. No approved or adopted FEMA flood plain information exists for the Colorado River on the site. A plat note should be included stating this fact and indicating the potential for flooding on the site. 3. An additional well permit or other source of domestic water for the proposed 30 acre parcel will be necessary. Well permits have been obtained for the remaining two lots. 4. The proposed lots will be the last allowed to be created by exemption from the definition of subdivision based on the Subdivision Regulations. A plat note should be added stating this fact. IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the following plat notes be included on the recorded exemption plat: No further divisions by exemption from the definition of subdivision will be allowed. Pdt 17 B. Individual Sewage Disposal Systems may be required to be designed by a registered professional engineer. C. No FEMA approved or adopted 100 year flood plain information was available for the site at the time of approval. The site does have low lying areas that may be subject to flooding. Any development or building on the site should take these facts into consideration. 2. The applicant shall establish the existence of access points for each lot or obtain the necessary access permits from the Colorado State Highway Department. 3. The applicant shall submit an additional well permit or evidence of another approved legal and adequate source of domestic water for the 30 acre parcel. 4.
