D. 19 82 , there were present: Larry Velasquez Flaven J. Cerise • meeting of the Board of County Commissioners for Garfield 4h unty, Colorado, Monday. ,the day of Eugene Drinkhouse when the following proceedings, among others were had and done, to -wit: , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board RESOLUTION NO. 82-08 RESOLUTION CONCERNED WITH THE APPROVAL OF THE SKETCH PLAN SUBMITTAL FOR COUNTRYSIDE SUBDIVISION. WHEREAS, Clifford Sisk and Tim Reynolds have filed an application with the Planning Department of Garfield County for the approval of a sketch plan in the R/L/UD Residential -Limited -Urban Density Zone District; and WHEREAS, based on the material submitted by the applicant and the comments. of the Garfield County Planning Department, this Board finds as follows: 1, That the sketch plan conforms to Section 4.01 Sketch Plan Requirements of the Garfield County Zoning Resolutions. 2. That the sketch plan conforms to the requirements of the zone district which the development is in. 3. That for the above -stated and other reasons, the proposed sketch plan appears to qualify for approval by this Board, NOW, THEREFORE, BE IT RESOLVED that the sketch plan of Countryside Subdivision for'the following described unincorporated area of Garfield County be approved: A parcel @f alnd situate in the NA NWS and the NE14 NA of Section 20, Township 6 South, Range 93 West of the 6th Principal Meridian and more particularly.described as follows: Block 6-A of the Rife Village South Subdivision, First Filing, recorded .as Document 227220 in the office of the Garfield County Clerk and Recorder. Said parcel of land contains 4.39 acres more or less. AND BE IT FURTHER RESOLVED that the following conditions shall be placed upon this approval: 1. That the main access around Block 6A and the internal roads within the subdivision be paved to county standards (chip and seal) and the roads be constructed within the existing platted right-of-way. 2. That curb, gutter, and sidewalks be required around Block 6A. 3. That questions on the availability of water and sewer from the Metro District be resolved at preliminary plat. Page 14 Phge 3 a6fitii • 5. That all the provisions for access reqeusted by the State Department of Highways be met prior to issuance of the special use permit. 6. That all transmission line towers be fenced with a 6' fence with barb wire across the top. 7. That an adequate setback on Highway 6 & 24 be built to accomodate a 4 -lane highway in the future. 8. Consideration be made for providing security subject to Sheriff McNeal's recommenda- tions. 9. A report be submitted to sanitarian on the water quality. 10. The county receive comments back from the Division of Water Resources and the Department of Health on water and sewage. John Tripp seconded the motion and the motion was carried unanimously. Dale Albertson felt thatthe PUD request should be tabled and the developers should talk with Davis as far as the Ford dealership is concerned. Dale made the motion to continue the hearing on the PUD at the next planning meeting on November 9, 1981. Dale McPherson seconded the motion and the motion carried unanimously. THIRD ITEM ON THE AGENDA -McGowan Zone Change. Terry Bowman reviewed the request from Resource Lands to Commercial/General on 2.6 acres of land approximately i mile west of Rifle on County Road 264. The proposed use is unsure, it could be electric supply or a mini -storage. Terry then read the recommendation for denial and the reasons for this recommendation. Mr. McGowan addressed this recommendation by saying the old 6 & 24 doesn't divide this property, that County M9d 264 does. Arnold asked McGowan what he had on his property now. McGowan replied he had a small shop, residence, and a few vehicles. After much discussion, in which McGowan felt he couldn't afford a PUD, and the Board couldn't grant a commercial use zone request, McGowan withdrew his request for a zone change. FOURTH ITEM ON THE AGENDA-Inglehart Commercial Park Terry Bowman reviewed the request for a commercial park West Glenwood a bout l mile west of the I-70 interchange. FIFTH ITEM ON THE AGENDA -Countryside Subdivisiaw Davis reviewed proposal for request for 22 single family lots on 4.52 acres, located in Rifle Village South Subdivision. Rifle Village South Metro is willing and able to provid, water to the subdivision. Davis then reviewed the concerns stated at the last P & Z meeting. Reynolds, developer, showed the map with the plans for the homes on each lot. Reynolds then gave a narration on the raads through the subdivision. Davis was concerned about the width of the right-of-way. Davis also felt that the roads inithe subdivision had not been accepted for county maintenance. However, Reynolds believed that some were. Davis then said that without a 60' right-of-way, the sketch plan does not meet county standards. Davis listed the recommendations with the conditions as follows: 1. That at least one lot on the cul-de-sac be eliminated to reduce the number of lots accessing the road. 2. That the main access roads to the project be paved to county stadards which would be suitable for urban density traffic. 3. That all lots have a suitable building site when all setbacks, roads, and parking are taken into consideration. Page 15 Page 4 • (• After much discussion it was decided that the condition number 1 could be withdrawn and that all roads would meet county standards. Davis read a letter from the City of Rifle. Dale asked for clarification on how much right-of-way should be added. Davis replied 5 more feet. Sisk_pointed out that if he was forced to pave all roads in the subdivision,that the peopled who already lived there would be getting paved roads for free. New residents would have to pay more. The property value of the existing homes would double. Dale thought dependability of water supply was unsure. If the irrigation supply quit, the springs would run dry. Arnold asked what the tap fees were, and Sisk replied $17,050. Davis said that the preliminary plat will decide the dispute over water and sewage. A legal ruling is needed and will be obtained. At this point, John Tripp asked if condition No. 2 about the paving of roads had to be enforced. Discussion followed. Dale McPherson made the motion to approve Countryside Subdivision with the conditions that the main access around the subdivision and the internal roads be paved to county standards (Chip and Seal) with the existing platted right-of-way. Also, curb, gutter, and sidewalk be required around Block 6A and that water and sewage questions be resolved at preliminary plat. Motion was seconded by Dale Albertson and carried unanimously. COUNTY ROAD 215 - Motion was made to approve County Road 215 by Dale Albertson. It was seconded by Dale McPherson. Evelyn McKay was appointed to vote. The motion carried unanimously. 72 /414/"vim Secr ry Page 16 Page 3 • ?7/ • SIXTH ITEM ON THE AGENDA-Donnegan Subdivision Davis showed the final plat for 11 lots on 10.45 acres located in West Glenwood. Rick Sherriff is the owner and Bill McDowell is trying to buy it. Davis then listed the conditions: 1. Lots 9, 10, 11 be residential and first to be developed. 2. Lots are to be released one at a time based upon water availabilty. 3. An easement be built across Lott 11. Discussion then followed with Bill McDowell not in agreement with the residential lots being built first. Barb stated that the reason for this was because of the water rights. Bill replied there was no shortage any longer. Barb felt that there was still a water shortage. Bill said the new water lines were big and there was good fire protection, water pressure, etc. This limitation is not needed. Ray asked if there was a letter to show proof of this new water situation. Davis said the committee had no such letter. Ray said if the stipulation was to be changed, a letter would have to be received to show proof. Bill felt the Water District forgot'to mention this in his letter but that it should be obvious to anyone. Dale asked if there was a ditch that went through the exempt lot. Bill said yes, and Dale asked if they weren't supposed to pipe that ditch. Davis looked on past minutes but couldn't find any such order to pipe it. Dale asked who owned the ditch. Rick Sherriff replied that Reynolds and Cane,did. Arnold asked if a ditch easement was needed on this. Bill thought it was inappropriate now, because things could change. Davis then found the covenants on the preliminary plat that showed limitations. Bill McDowell found several problems with them. He suggested to Sherriff not to agree to them. However, after Davis re -read them, Sherriff felt that since he had originally agreed to them, he had to stick by them. B v4.s recommended approval with the following conditions: •1. Lots to be released on a per lot basis, unless a letter is provided from West Glenwool Water District stating they can serve the entire project. 2. Reynolds and Cane ditch be piped as per ditch company's specification. 3. A sidewalk compariable to the one on the one on the Taco John property be constructed along the west side of the subdivision. 4. Lots 9, 10, 11 will be residential and a statement will be placed in the covenants. 5. The original covenants as submitted at the preliminary plat be adopted. John seconded and a poll was taken with the following results: Mackley, Albertson, Bowles, 7 ipp: YES / Lorah: NO SEVENTH ITEM ON THE AGENDA- Inglehardt Commercial Park Terry Bowman reviewed the location of the lot located in West Glenwood approximately 1 mile west of the 1-70 interchange. Barbara asked fpr the uses of this park and Terry listed them. Arnold asked how many spaces were in the Storm King Trailer Park and Fred said 52 with a laundry room. Discussion followed in which it came up that there was only 10 feet between Inglehardt's proposed building and the BLM building since the BLM built right on the property line. Parking discussion insued: The Inglehardt Commercial Park was tabled until the next meeting on October 26, 1981. ¥ICRTR ITEM. ON TSN AGENDA -Country Side Subdivision Sketch FEa, Davis reviewed the sketch plan for the request for 22 single family lots on 4.52 acres located in Rifle Village South Subdivision. Tim Reynolds, developer, showed that sketch plan. He mentioned that they will upgrade all streets and stay within the single-family concept. Sisk and Reynolds met with the Rifle Village South Metro District, and they will provide water and sewer. Sisk and Reynolds also talked with Public Service for underground utilities. Davis asked if a site review should be scheduled. Arnold thinks that there already was one before the excavation. However, a site review was scheduled for 6:30 PM, October 15. Meeting was adjourned.
