As I previously stated in our telephone conversations, 1 own this said residence together with forty acres and several different structures. The structure in question is the main residence, which is rented out to help. The previous tenant caused extreme damage to the residence. The majority of said damage was cosmetic in nature. Upon reentry of the premisses, following the eviction, the kitchen has been destroyed and the kitchen cabinets' doors have been ripped off. 1 have replaced the kitchen cabinets together with performing cosmetic work to the plaster in the kitchen and I intend to replace some flooring and repair the damaged lights. In the living space of the house, I intend to repair any and all damaged windows and doors. 1 will repair and replace any and all plastering, flooring or ceiling. In addition, 1 received a permit and replaced the coined filled fuse Box with the breakers. That inspection has occurred. There are several leaks in the pluming, including but not limited to the existing toilet structure for which I am repairing/replacing. The structure of the house hold will remain essentially the same. The structure is in excessive of a hundred years old and that it is the original homestead and unchanged of the property. My sole intention to take an existing 100 -year-old structure and repair and/or replace those items which are damaged in order to make a nfore secure and safe environment for my tenants, Please find enclosed a handwritten contract pursuant to your letter date July 14, 2003. As we had discussed I have inquired on two properties as to the need for a permit and I was advised to obtain a permit for the Mathew Kaufman Property and that the repairs on the rental property did not require a permit. I met with your tenant Mark Jackson last July and expressed the need for an engineer to review both the existing building construction and any new concealed construction for compliance with the code. In your conversation with David you indicated to him that any remedial work required by the engineer that examined the building was worth more than the building itself. You expressed to David that you were unsure in which direction to go with possibly evicting the present tenant and tearing down the existing structure as one option. The options are yours to make. If the tenant is living in what an engineer would consider an unsafe condition, the liability is there for the owner of the property. You obviously are able to gage the amount of liability based on your profession. From the Building Departments perspective, the project needs to either be brought up to date with amended plans and finished as was outlined with Mr. Jackson last July or the project needs to be stopped and the building made safe and code compliant at whatever stage it is in. We are willing to extend the permit due to the complexity your situation but a decision needs to be made by you on what direction to go with the project. Many requests by several different employees of the Garfield Building and Planning Department to inspect the work were ignored by the owner.
