HomeMy WebLinkAbout1.0 Application• BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO PETITION FOR EXEMPTION Pursuant to C.R.S. (1973) Section 30-28-101(10)(a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, the undersigned Ronald B. Liston respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution SE 4, SW4f Sec. 13, T4S, R92W, 6th P,M. (see Attachments B & C for location maps) more fully hereinafter described, from the definitions of "subdivision" and "subdivision land" as the terms are used and defined in C.R.S. (1973) Section 30-28-101(a) - (d) and the Garfield County Subdivision Regulations for the reasons stated below: of see Attachment A Submitted at Glenwood Springs, Colorado, this 13 day October , 19 77 3-6734 ATTACHMENT A. Petitioner request exemption for the following reasons: 1. Petitioner requests a single split of the property into two parcels of approximately 9 and 31 acres. 2. There are no existing site conditions contrary to the intent of the subdivision regulations. a. A residence presently exists on the 31 acre parcel and a stable building site of adequate size is located on the 9 acre parcel. b. Domestic water will be provided through indivi- dual wells or a common well. A successful well on adjacent property varifies the availability of adequate ground water. c. There is safe access to County Road 245 through common use of the drive serving -the existing residence and/or from the potential alignment modification of the old homestead access drive. d. Building site conditions appear adequate for septic tank and leach field. 3.
