A RESOLUTION CONCERNED WITH GRANTING AN -EXEMPTION FROM THE GARFIELD COUNTY 'SUBDIVISION
REGULATIONS FOR GEORGE AND ESTELLE LOCKE.
WHEREAS, George and Estelle. Lock have petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption from the definition of the terms
"subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979,.
Sections 2.02.21 (d) and 3.02.01 for the division of a 6.40 acre tract described as follows:
A parcel of land situated -in Lots 21 and 30, Section 1, Township 7 South,
Range 89 West of the Sixth Principal Meridian, Garfield County, Colorado,
lying Westerly of a•:chain link fence as,now constructed and in place,
Westerly of the Centerline of the Glenwood Ditch, Easterly of a 30 foot
road easement, and Easterly of the Westerly line of a 20 foot road easement,
saidparccl of land is more fully described as follows:
Beginning at a point on the Northerly line of a road easement, whence the North-
east Corner of Lot 20 in said Section 1 bears: N.57°28'56"E. 1538.17 feet; thence
S.48°05'53"W. 192.38 feet along said Northerly 'road easement; thence 5.41°54'07"E.
44.11 to a point in said chain link fence; thence, along said chain link fence,
S.21°54'35"W. 34.14 feet; thence S.18°09'20"W. 199.96 feet; thence S.39°48'01"W.
91.93 .'feet;'. thence S.12°34'45" E. 277.42 feet; thence S.08°17' 23''E. 139.55 feet to

The above described parcel of lane! combines the parcels of land described by
Documents No. 249688 and 275972 and the Quit Claim descriptions for th-,1\
common boundary line along the chain line fence.

of the Centerline of the Glenwood Ditch, Easterly of the Westerly line
of a 20 foot road easement, and Easterly of the Easterly line of a 30 foot road
easement, said parcel of land is more fully described as follows:
Beginning at a point in said chain link fence, whence the Northest Corner of
Lot 20 in said Section 1 bears: N.50°50'44"E. 1916.10 feet; thence S.39"48'01"W.

(in the State of Colorado and County ol Garfield); and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that the proposed division does not fall
within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973,
as amended, for the reason that the impact created does not warrant further subdivision
review, and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that there is a reasonable probability of
locating domestic water on each of said tracts, that there is adequate ingress and egres
to said tracts, that the location of septic tanks will be permitted by the Colorado Department
of Health, that the requested division is not part of' an existing or larger development
and does not fall within theg eneral purposes and intent of - thesubdivision regulations
of the Stateof Colorado and the County of Garfield, and should, therefore, be exempted
from the definition of the terms "subdivision" and "subdivided land" as set forth in
C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended;

NOW, THEREFORE, BE IT RESOLVED that the division of the above described tracts
"A", "B" and "C" from the above described 6.40 acre tract is hereby exempted from'
such definitions and said tract may be divided into tracts "A", B and "C", all
as is more fully described above, and said divided tract may be conveyed in the form
of such smaller tracts without further:. compliance with the aforesaid subdivision
statutes aid regulations; provided, however, that this exemption is granted on the
condition and with the express understanding and agreement of the Petitioners that no
further exemptions be allowed on said tracts "A", "B", and "C", and that a copy of
the instrument or instruments of conveyance when recorded shall be filed with this
Resolution.
