RE: Snidow Exemption and Holmes Creek (Locklear) Exemption
Dear Ms. Purcella and Mr. Call,
This is a follow up letter to our conversations on Friday, June 6, 2003. In reviewing the
title information provided with both applications that have been submitted to our office
for an exemption to the definition of subdivision, it appears that at a minimum, the
exemptions allowed under Section 8:00 of the Subdivision Regulations, for the originally
408 acres, have already been utilized in the following manor:
Exemption 1: Original 408 acres of land (Book 277, Page 493).
Exemption 2: 182.6 acres transferred from the 408 acres on October 25, 1988
(Book 744, Page 637).
Exemption 3: 80 acres transferred from the 182.6 acres on January 7, 1993 (Book
853, Page 819).
Exemption 4: 40 acres transferred from the 408 between 1954 and 2001.
Therefore, neither properties can qualify for an Exemption. In order to subdivide the
properties as requested, the property owners will need to go through the Subdivision
process as outlined in section 3:00 (Sketch Plan), section 4:00 (Preliminary Plan) and
section 5:00 (Final Plat).
Should your clients decide to withdraw the Exemption applications, we will reimburse
the portion of the base fee / application fee that has not been used during the review of
the application materials. Please notify me in writing as to how your clients would prefer
to proceed.
