WHEREAS, Garfierd county is a regal and political subdivisionof the state of cororado f o*ti"r, the Board of count.yCommissioners is authorized to act,. and
WHEREAS, the Board of County commissioners desire to vacate aportion of a dedicated public road right_of_way, as such Lieswithin the property of th; affected p..iy -= se1 forth berow; and

WHEREAS, t,he purpose of t.his proceeding is to vacate thatportion of the dedicated road right.-ot-rry to Count.y Road 109 whichis no longer required for road p,r.po=e=.
WHEREAS, the Board of County Commissioners of Garfield County,colorado, is entiLred to accept iight-of-ways properly dedicated tothe pubric, for use by the public, and on behal_f of the public,pursuant to the provisions of SecLion 43_2_z}t(1) (a), C.R.S., asamended; and
Now, THEREFORE, BE rr RESoLVED By the Board of CountyCommissj-oners of Garfield CounLy, as foLlows:
1. That the public meeting leading t,o vacation of thisroadway was the subject of necessary notice to landowners adjacentto the roadway, to the ext.ent. such not.ice was required uv theprovisions of Section 43-2-303 (2) (b) , C.R.S., as a*e.rded
2 - That. a public meeting was conducted at which testimonyand evidence was presented concerning the vacation of portions oithe subject road. No test.imony or evidence was presente-d objectingto said vacation. Exhibits were presented supiorting the iirrai.r!of proper notice, if needed, ana jIr interested partiEs were givenan opportunity to attend, testify and present evidence.
3. That portion of the public road right-of-way of countyRoad 109 no longer needed for road purposes and described inExhibits A and B attached hereto, should be and hereby is vacated.
4 - That pursuant to the foregoing vacat,ion, title to suchproperty shall vest in the adjoining property owner(s), coRyELLRANCH COMPANY, L.L.c., a Cor-orado rimiCed -ri-auiriLy
company.
5. The foregoing vacation does not r-eave any propertyadjoining said public road right-of-way without an establishedpublic road connecting said land with another established publicroad.
