Re: Vacated Easement and Boundary Line Adjustment.
Dear Sirs:
I am requesting that a boundary line adjustment be made toLot#Z of the Englund/
Moore Subclivision and Lot'B' as reflected on enclosed survey map from Sopris
Engineering.
The new purposed bountlary line is highlighted in orange. The old boundary line is
highlighted in green. The reasons for this are, first the chain link fence which was
part of the old description has been removed and we wanted to straighten out this
irregular line. Second, a small200 square foot structure that is straddling the lot
line labeled 'C' in red rvould now be entirely on Lot 'B'.
Also, we wanted to vacate the original easement for Lot#2 highlighted in pink for
the new easement highlighted in yellow. I am also enclosing a copy of the access
permit from CDOT ftlr this new entrance.

2' Expenscs of Plat Arnendment/Bound.arv Line Adiustment. Tho Moores shall be
solely re.sponsible for all fees and expenscs associrrted with accomplishing the plat amendment or
boundary linc adjustrnent, including withour limitation survey ex.penses, applicition fees, amendecl
plat PreParation, costs associaterJ with preparation of dcerls andother documcnts, recording fees,
attorncys' fees and the like.
3. Processing of Application- As promptly as reasonably possible fotlowing
execution of this Agreenrent, the Moores shalt submit such application as may be required by
Garfield Courty to etfectuate the adjustmeut ofthc boundary lines berween the Moore Property anrl
the Mulkey Propcrty and pay all costs and fecs associatetl therewith. The Moores strall coniinuously
and diligently pursuc the processing of such application througlr conrpletion.
4. Dcnial of4pplicatirln/Permanent Eas.cmen(. Irr the event Garfield Counry denies
the applieation suhmittal by the Moorcs such rhat it is not possiblc to rccord an amended plat of Lot
2, Eflglund - Moore Subdivision, or should Garlieltl, County deny a bounclary line iriljustment
application or other application intended to effectuate thc adjustmenr in the boundary lines betwe-en
thc Moore Property aud the Mrrlkey Property, Mulkey shall grant to thc Moores a permanent,
cxclusive eirsenrent covering the areas depicted on E.rhibit ..EI" as described above, which easemcnt
-shall allow the permanent location and maiuteuflncc of the existing encroachments. In thc cvcnt it
is necesstry to grant a permanent easemeilt, the easement documentation shall bc rcasonably
acccptable to both paftjes, shall inclurlc a survey depicting the location and extent of the
encroacltments, shall allow for tlre installation of fencing along thc common property boundary as
established by thc permarent easement, shall requu*,- thc Moores to indcmnifi and hold harmlcss
Mu1key in connection with any claims, damages, losses or causes of action arising out of or in
connectiou with the permanent qlsement, aud shall requiru the Moores ro obtain antl maintain at their
expcnse insurance covering the pcrmancnt sasement with limits which reasonably protect Mulkry
from third-party clairns of liability, naming Mulkcy as an additional insured-
5. TcrmiEation of this AFeement. Upon the approval and recordation of an
arnencled plat or boundary line artjustment documcntatioil adjusting the boundaries between the
MoorcProperty antl the Mulkey Propeny as described above and dqricted on Exhibit"B," or, should
approval for the adjustmcnt of the property line not be obtained from Carficld County, upon the
execution and rccord',rtion of a permanent easement agr€emcnt, this Agreernent shall automatically
terminate and thereafter shall be of no lurther fbrce and effect.
6- Misf:ellaneous- This Agrccmcnt constitutes the entire rurderstanding betwecn tho
partics rcgzudingthe subjec't matterhercof, super.setlesanyand allpriorverbal orwrittenagreemenls,
rnd may only bc moditied or anrended in writing signed by thc parties. This Agreement shall be
cotutrucd and interpretetl in accordancc with the Iaws of the State of Colorado. This Agrccmcrrt
shall be binding upon and inure to the benefit of the parties hereto and their respective heirs,
succe-ssors and assigns. In the event of any dispute regarding this Agreemeng the parties agrec to
submit such dispute to binding arbilration under the rules ofthe ArncricanArbitration Association.
In such arbitration, thc prevailing party shall be awardcd all reasonable costs and attorneys' fces

Re: Vacated Easement and Boundary Line Adjustment.
Dear Sirs:
I am requesting that a boundary line adjustment be made toLot#2 of the Englund/
Moore Subdivision and Lot 'B' as reflected on enclosed sun ey map from Sopris
Engineering.
The new purposed boundary line is highlighted in orange. The old boundary line is
highlighted in green. The reasons for this are, first the chain link fence which was
part of the old description has been removed and we wanted to straighten out this
irregular line. Second, a small200 square foot structure that is straddling the lot
line labeled 'C' in red would now be entirely on Lot'B'.
Also, we wanted to vacate the original easement for Lot#2 highlighted in pink for
the new easement highlighted in yellow. I am also enclosing a copy of the access
permit from CDOT for this new entrance.
