Luther E. Moore. Lot2, Englund/lvloore Subdivision and that property described at Reception Number 512672. Situated in a portion of Lots 6, and 11 - 13, Section 32, Township 7 South, Range 87 West of the 6s P.M. AgriculturallResidential/Rural Density (A/RIRD). m IV The applicant, Luther E. Moore, is requesting a Plat Amendment to adjust a lot line, and vacate an existing easement to be replaced by another easement on the same properly (Lot B on Plat). DESCRIPTION OF TI{E PROPOSAL The proposal is for anAmendedPlat to adjust the commonlot line'between-LotB and. Lot2 as depicted on the submiued plat, and vacate the existing easement highlighted in purple on the submitted plat and replace it with the proposed easement highlighted in yellow on the submitted plat. RELATIONSHIP TO T}IE COMPREHENSIVE PLAN This application is in compliance with the Garfield County Comprehensive Plan, 1984, as amended. GARFIELD COUNTY ZONING RESOLUTION: The subject properties are zoned Agricultural/ResidentiaURural Density (A/R/RD). Sect ion 3. 0 2 A/R/RD - Agricultural/Res ident ial/Rurol Dens ity : Minimum Lot Area: Two (2) acres. Existing Lot B is only 0.907 acres making it a non-conforming lot. However, the lot line adjustment will add acreage to this lot, thus, not making it "more" non-conforming which is acceptable. Lot 2 will be continue to be in excess of two (2) acres, meeting the minimum lot area requirement. This application is in compliance with the Garfield County ZorutgResolution of 1978, as amended. V SUBDTVISION REGULATIONS: 6:00 Amended and Conected Plats 6: I0 An amendment mry be mode to a recorded plat, tf such amenciment cioes not increase the number of subdtvision lots or dwelling units, result in the major relocation ofa road or add new roads. This applied for Amended Plat does not increase the number of subdivision lots or dwelling units, and it does not result in the major relocation of a road or add new roads. Arry proposed amended plat relocating two (2) or less property lines common to two properties, may be approved by the Board of Comty Commissioners at a public meeting. (ee-0e6) The proposed Amended Plat relocates one (1) properly line common to two (2) properties and vacates an easement to be replaced by another proposed easement. This application is in compliance with the Garfield County Subdivision Regulations of 1984, as amended. VI OTFIER ISSUES: The applicant should be aware that any lien holders of the subject properties will have to sign the Amended Plat to be recorded. VII. SUGGESTEDFINDINGS: 1. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 2 2. That for the above stated and other reasons, the proposed Amended Plat is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 3. That the application is in conformance with the Garfield County Zontng Resolution of 1978, as amended. 4. That the application is in conformance with the Garfield County Subdivision Regulations of 1984, as amended. 5. That the application is in conformance with the Garfield County Comprehensive Plan of 1984, as amended. VItr RECOMMENDATION Staffrecommends APPROVAL of the applied forAmended Plat.
