Scott Aibner, County Surveyor and Karla Bagley, County Treasurer have also signed the plat. The plat will be delivered to you today to obtain the Chairman's Signature per the BOCC motion on August L0th. The Applicant has requested that the plat be signed as soon as possible to facilitate their closing schedule. We request that the plat will be held by your Recording Department and not recorded until such time as the Applicant's Title Company brings to your Office additional documents to be recorded concurrently and the fees for recording of the plat. o There are also two blanks in the Title Certificate that will need be completed by the Title Company at the time of recording. The blanks are for the reception no. for new deed of trust. o The Applicant has been advised that the Power of Attorney for Mark Chain needs to be recorded prior to the Plat. They have represented that they will record the power of attorney prior to the plat as directed. Chuck Dorn from Title Company of the Rockies is our contact with the Applicant's Title Company and will handle the recording. They have indicated that they anticipate recording everything early next week. Please contact me if you have any questions or if I can be of assistance when all the documents come in for recording. Please provide us with the reception numbers for the recordings once complete so we can add them to our files. Dear Ms. Cave, This letter is in regards to a refinance of a mortgage for James and Conne Bazley by Fairway Independent Mortgage Corporation ("Fairway") of the property located at 5966 County Road 109, Carbondale, CO; A TR IN LOT l1 CONT 2.88 AC, county of Garfield, State of Colorado ("Property"). The property is part of the Snobble Exemption. The owners of parcels within the Snobble Exemption wish to make lot line adjustments, concurrently with the recording of the new plat for the Amended Snobble Exemption. A Quit Claim deeds will be recorded transferring portions of land from one owner to the other in order to accomplish the lot line adjustments. The most efficient way to accomplish everyone's goals is to have Garfield County Commissioners approve the Amended Plat for the lot line adjustments with the requirement that the QC deeds and our new DOT be recorded in sequence at the end of the rescission period on Fairway's new loan with an already updated title and deed. As a part of our refrnance, we will obtain a payoff statement from the current lender Nationstar Mortgage ('Nationstar") and we will direct the title company to make that pay off through Fairway's new loan proceeds. Nationstar will release its lien upon receipt of the payoff. Fairway can provide a copy of the payoff statement to the County. Please let me know if you have any further questions. Owner has been requesting current lender (Nationstar) sign the plat - for 3 years. Nationstar refuses to sign. Owner can refinance and pay off current lender - Nationstar. County requires new lender to close loan using current legal description. New lender closes refinance loan (pays off existing lender (Nationstar) under current legal description. This deed of trust will be held pending recording of the Amended Plat. Owner/borrower also signs another deed of trust with new legal description. County Commissioners sign Amended Plat. Amended Plat is recorded. Title company records deed of trust with Amended legal description. Title Company provides loan title policy with new description. Bazley Amended Plat Current Policy - with Exception County approves Amended PIat subject to new Lender closing refinance and paying off current lender (Nationstar). No need for new lender to sign the Amended Plat. Title company signs plat on day of closing stating existing lien is being paid via refinance and a new lien is pending recordation. At time new lender funds the refinance, the Amended plat is recorded immediately prior to recording of the new deed of trust. Any "Policy" - by definition - is a generalization or statement of how you would "like" it to go. There ore exceptions thot need to be mode to "Policy" from time to time in order to work or deal with the "Policy". lf the same outcome con be accomplished more efficiently and ot less cost to all involved, then on "Exception" can and should be mode. Our closing is planned for 8lI0lL5. Since this is a refinance, the loan documents will be signed on 8/10 and funding will occur on 8/74115. Our new loan will be secured by a deed of trust on property identified by the new legal description We have no interest in the property until we close our loan; therefore, we have no basis for approving the lot line adjustment. We will pay off the existing Nationstar Mortgage at time of closing. With the borrowers' approval, we can provide you a copy of the payoff statement from Nationstar. Her contact is Linda McKinley (945 - 4001) o their closing date is towards the end of August, but it would be best if we could have the plat redone and take it to the B O C C bythe end of July. o As an FYl, Connie's son has been added to the title for lots a and C. His name is Cameron Bazley. His name will need to be added to the signature block for the plat. o Chuck Dorn will be signing the title certificate. He did the work and obtained the title commitments earlier on in the process. Local branches Stewart title have been absorbed or somehow otherwise are now part of Title Company of the Rockies. o Frank Harrington will be putting together a new plat. o then, the surveyor and title company will execute their signature blocks on the plat. The lot owners will then also execute the plat. As an FYl, I have power of attorney for all owners with the exception of Cameron. o lt is our intention to get the plat executed by these various parties and then turn it over to you so that it can be scheduled on the consent agenda at a commissioners meeting. o lt is the intention of the new mortgage company and title company to have a simultaneous closing. By this, I mean that the plat will be recorded, and then immediately afterward the new mortgage documents will be filed with the clerk and recorder's office. Nationstar will be paid off and will not need to sign the plat. The only question I have at this time is whether fairway independent mortgage will execute the plat prior to handing it over to the county for scheduling with the commissioners or if they will wait to sign until the actual closing. I will find this out in the next couple of days. I hope this explains in an adequate fashion the steps that will be taken to finally put this application to bed.
