yHEREAS, wayne Rudd and filed an application with the Board of county commissioners
of Garfield county for approval of a preliminury u* for Evergreen commerciar center.
WHEREAS, based on the material submitted by the applicant and then comments of the
Garflreld County Planning Departrrent, this Board frnds as follows:
I . That proper publication, public notice and posting was provided as required by law for
the hearings before the Planning commission and Board of county commissioners'
2. That the hearings before the Planning commission and Board of county
Commissioners wereextensive and complete, that all pertinent facts' matters and issues
were submitted and that all interested parties were heard at that hearings'
3. That the Garfreld county planning commission recorrmended approval of the
Preliminary Plan.
4. That the proposed subdivision of land is in compliance with the recommendations set
forth in the comprehensive Plan for the unincorporated area of the county'
5. That all data, surveys, analyses, studies, plans and designs as are required by the State
of colorado and Garfield county have been submitted, reviewed, and found to meet
all sound planning and engineering requirements of the Garfield county Subdivision
Regulations.

7. That for the above-stated and other reasons, the proposed subdivision is in the best
interest ofthe health, safety, morals, convenience, order, prosperity and welfarc of the
citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plan of Eastbank Commercial
Center for the following described unincorporated area of Garfield County be approved with the
following conditions:
All representations of the applicant, either within the application or stated at the public
hearings before the Planning Commission shall be considered conditions of considered
conditions of approval unless otherwise stated by the Planning gsmmission.
The applicant shall establish a Homeowner's Association. The Homeowner's
Association shall be incorporated in accordance with the Colorado Revised Statutes.
The protective covenants, articles of incorporation and other Homeowner's Association
documents including by-laws will be submitted for review by the County Attorney prior
to the approval of the Final Plat.
Prior to the submittal of the Final Plat, the applicant shall provide adequate written
verification form the Division of Water Resources documenting approval of the
commercial water supply.
All roads including the proposed cul-de-sac shall be designed and constructed in
accordance with minimtrm County standards for a rural access road, with on street
parking allowed on the portion of the R.O.W. not includ:O t the driving surface.
The applicant shall demonstrate that there is enough area to provide the required
physical separation between any sewage disposal systemleach f,rled and the well serving
the development, any nearby property wells, and any other separations required by the
ISDS regulations prior to any Preliminary Plan approval by the Board of County
Qgmmissioners.
That the applicants building plans will be limited to 200 sq. ft. of office/retaiVwholesale
area per parking space, based on the parking spaces shown on the Preliminary Plan
dated 9129194 and revised 116/95.
The applicants shall provide an agreement with the owners of HLazy F Mobile Home
Park sewage treatment facilities to connect into the system prior to hnal plat approval.
Further, if an agreement is reached, improvement plans submitted at the time of hnal
plat shall include sewage lines connecting to the sewage treatment facility to Lots I &
4. Lots 2 &,3 can use existing Individual Sewage Disposal Systems.
8. Any final plat shall include the following:
a. A legal description of ea,ch lot approved;
b. A legal description of the foot print of the fourplex;
c. Lrgally described easements for any sewage disposal system lines and/or sewage
absorption helds not contained in the same parcel.

d. Off-street parking spaces for each lot, based on a maximum occupancy of each
building.
e. A plat note stating "the fourplex will only be sold as a complex, unless a plat legally
aescriUing condominiums and complying with the State statutes and County subdivision
regulations regarding condominiumization of an apartment."
