I. DESCRIPTION OF THE PROPOSAL The owners of Lot 5 (a currently vacant lot) request approval to slightly expand the southerly portion of their building envelope by approximately 8 feet to the south. The subject property is located at the end of Surrey Street (cul-de-sac) and bordered by Sopris Creek on the west side. The areajust south of the existing building envelope is delineated as a jurisdictional wetland by the US Army Corps of Engineers. Recently, in anticipation of expanding the building envelope to the south, the owners retained Ecological & Environmental Consulting to reexamine the wetland area. In effect, for a variety of reasons over the last five years, the analysis revealed that the wetland area had changed and, as a result, was re-delineated further south. This new wetland delineation was field checked and accepted by the US Army Corps of Engineers. In addition, the owners recortly received approval from the Ranch at the Roaring Fork HOA to request an expansion ofthe building envelope based on the change in the wetland area; however, the Ranch has required the owners to submit the verified ohanges as approved by the Corps. The plans show a 10 foot buffer will continue to be maintained from the newly expanded southern boundary of the building envelope and the newly delineated wetland area. Confirmation of this information is found in the application materials. With the exception of relocating the original wetland line and southerly portion of the building envelope for Lot 5, the amended plat is consistent with preliminary plan. (Staffdoes note, the new wetland delineation does affect other adjacent lots that are not the subject of this application. Those lots will also have the opportunity to appear before the Board to address their specific requests.) II. AUTHORITY Section 6:10 of the Subdivision regulations states that an amendment may be made to a recorded plat, if such amendment does not 1) increase the number of subdivision lots or dwelling units, or 2) result in the major relocation of a road or add new roads. This request will not result in either of the two aforernentioned standards and Staff finds these standards are met. Thurber Amended Plat BOCC - 06/07/04 Page 2 ilI. STAFF RECOMMENDATION The Applicant has provided all required documentation and has satisfied the applicable standards for a plat amendment. Therefore, the Planning Staff recommends that the Board of County Commissioners, pursuant to Section 6:10 of the Subdivision Regulations of 1984, as amended, approve this amended plat request with the following conditions: 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval. 2. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy), then signed and dated (mylar copy) by the County Surveyor, than signed and dated by the Chairman ofthe Board and recorded in the Clerk and Recorder's Office of Garfield County. The Amended Final Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in Section 5:22 of the Garfield County Subdivision Regulations.
