A.D. 2002, there were present: John Martin -, Commissioner Chairman Larrv McCown - Commissioner Walt Stowe Commissioner Don DeFord , County Attorney Mildred Alsdorf Ed Green , Cor:nty Admini strator whenthe fotlowing prooeedings, alnong others were had and done, to-wit: RESOLUTION NO. 2002-56 A RESOLUTION CONCERNED WITH TI{E APPROVAL OF A PRELIMINARY PLA}'I FOR THE LJ SUBDTVISION WHEREAS, Ken and Carol Call have filed an application with the Board of County Commissioners of Garfield County for approval of a Preliminary Plan forthe LI Subdivision; WHEREAS, the Garfietd Cotrnty Planning Commission reviewed the LJ Subdivision preliminary Plan subdivision application and recommended approval to the Board of County Commissioners; WHEREAS, based on the material submitted by the applicant, the recommendation of the p[anning Commission, and the cornments of the Garfield County Planning Departmen! this Board finds as follows: That proper publication, public notice and posting was provided as required by law for the hearings before the Planning Commission and Board of County Commissioners. That the hearings before fhs planning Commission and Board of Cormty Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard atthose heuings. ) )ss ) 1. 2. That all dat4 surveys, analyses, studies, plans and designs as required by Colorado and Garfield County have been submitted, reviewed, and found sound planning and engineering requiretnents of the Garfield County Regulations. 5. That the proposed subdivision of land conforms to the Garfield County Zonng Resolution. That the Garfield County Planning Commission recommended approval of the Preliminary Plan. 6. the State of to meet all Subdivision reasons, the proposed subdivision is in the best convenience, order, prosperity and welfare of the 1. NOW TI{EREFORE, BE m RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the LI Subdivision Preliminary Plan is hereby approved subject to compliance wittr all of the following specific conditions: That alt representations made by the applicant in the application, and at the public hearing before the Board of County Commissioners, shall be conditions of approval, unless specifically altered by the Board. The Division of Wildlife reconrmendations shall be followed including: Moving the building envelope on Lot I as far south as possible to maintain the native mountain shrub commnnities existing on the site Fencing should be held to a minimun with a malrimum height of 4T' for wire fencing with no more than 4 stands and a 12" kickspace between the top two strands Rail fencing shall have a maximum height of 42" with at least 18" between the two rails Mesh fencing is strongly discouraged The applicant shall use bear-proof tash cans All pets shall be fed indoors Birdseed feeders should be stnrng at least 10 feet from the ground with a seed catchment to discor:rage other wildlife foraging. The applicant shall submit covenants for the subdivision which shall include: Enforcement provisions regarding dogs and exterior lighting pursuant to Section 9.15 and 9.17 of the Subdivision Regulations Weed \danagement Plan approved by the Weed Management Director The Division of Wildlife recommendations as listed in ConditionNo. 2 above ISDS ManagementPlan Approved Wildland Fire Hazard Fuels Mitigation Plan Provisions of the Home Owners Association which will own and operate the water system along with the proposed method of frnancing the system The newly created lot, Lot 1, \Mill have access from VanDorn Road on Driveway Option #1 listed onthe submitted Preliminary Plan Platper Road and Bridge recommendations.
