4. Copies of the two deeds under which the Martin received title and a copy of
their title insurance commitments.
5. Names and addresses of owners of record of real property within 200 feet of
the subject property. In searching the county treasures records we find no
leases of mineral rights or owners of rights separate from the real property.
There are no leased structures proposed for conversions.
6, Letter regarding soil type.
7. The l\lartins have applied for a well permit and ask that approval be granted
conditioned upon receipt of a well permit.
Septic service will be provided by a standard se;ltic tank and leach field built
to state and county specilication.
The Martins have discussed the site and its location with the Carbondale
Rural Fire Protection District and a letter will be forthcoming from the
district.

NARRATIVE
Ronald and Margery Martin Property
We request an exemption as a means of clarifying an
interpretation of the County Regulations. We orvn two tracts
of land that share a common boundary. These tracts are
shown on the attached map (Exhibit A) and labeled Tract # 1
and Tract # 2. Traca # I was purchased in 1979 and has our
home on it. Tract # I was legally divided in 1977 by
Resolution # 77-64 (SB 35 Exemptions) and we attach a copy
of that resolution labeled Exhibit B
We purchased Traca # 2 in 1987 and it is a vacant tract of
Iand. Tract #2 was part of a 12 acre tract of land owned by
the Callicotte family. This tract of land is outlined in yellow
highlight on the attached Exhibit A. In 1967 Judith Callicotte
owned this property and sold 4 acres of the property to Jesse
D. Callicotte. This 4 acre tract is outlined in red. We attach
the deed trom Judith to Jesse Callicotte as Exhibit C. This
sale occurred before Senate llill 35 and by the process created
our 8 acre tract. The tract rvas sold to us by the heirs of
Judittr Callicotte (Roger and Del Callicotte). We attnch the
trvo deeds from Roger and Del Callicotte as Exhibit D.
We believe that both trncts of land are legally created under all
applicable regulation. We want to convey Tract # 2 to a third
party. The county attorney suggests that we obtain an
exemption because the 2 tracts share a common boundary. We
respectfully petition you to grant said exemption.

of Garfield county, colorado, for an exetnption under c.R.s. (1973) Section 30-28-
l0l (10) (a) - (d) as anrended, and the Subdivision Regulations of Garfield County,
Colorado, adopted Septenber 1,1972 and amended ApriI 14, 1975, Sections 1'02'
l7 (d) and 3.02.01, for the division of an 8.1669 acre tract of land into two (2)

WHEREAS, the Petitioner has shown to the satisfaction of the Board of County
Conmissioners of Garfjeld County, Colorado that she desires said exemption for
the purpcse of re-sale into'single-farnily residential acreage; and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water on each of
said tracts, that there is adequate ingress and egres.s to sa'id tracts' that the
location of septic tanks will be permitted by the Colorado Department of HeaIth'
that the requested d'ivision is in accordance with the general purposes and intent
of the Subdivision Regulatjons of the State of Colorado and the County of
Garfield and should therefore, be exempted from the definition of the terms
,,subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-
28-l0l (10) (a) - (d) as amended;

The Martins have applied for a well permit and ask that approval be granted
conditioned upon receipt of a well permit.
Septic service will be provided by a standard septic tank and leach lield built
to state and county specification.
The Martins have discussed the site and its location with the Carbondale
Rural Fire Protection District and a letter will be forthcoming from the
