A RESOLUTION CONCERNED WITH GRANITING A}I EXEMPTION FROM THE GARMLD
COUNTY SUBDTVISION REGULATIONS FOR JOHN MARTIN.
WHEREAS, John Martin petitioned the Board of County Cormrissioners ofGarfield Counfy,
Colorado, for an exerrption fiom the definition of tlre terms "zuMivision" and "suMivided land"
under C.R.S. 1973,30-28-101 (10) (a)-(d), as amended, andthe SuMivisionRegulations ofGarfield
Coudy, Colorado, adopted April23, 1984, Section 8:00 through 8:60 and for the division of a927
apre tract as descnibed in Book 42l,Page 446; as filed inthe Offices ofthe Clerk and Recorder of
GarfieldCounty,Colorado,intotwo(2)tractsofapproximately5.00l and43.160acreseachwiththe
exemption parcels more practically as follows:

WHEREAS, the Petitioners have demonstrated to the satisfrction ofthe Board of County
Comnrissioners of Garfield County, Colorado, that the proposed division does not fall within the
purposes ofPart l, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason
that the division does not warrant further suMivision review; and
WHEREAS, the Petitioners have demonstrated to the satisfrction of the Board of County
Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating
domestic water on each of said pmcels, that there is existing ingress and egress to said parcels, that
the location of septic tanks will be permitted by the Colorado Department of Health, that the

Garfield, and should, tlerefore, be exempted from the definition of the terms "subdivision" and
nsuMivided land" as set forth in C.R.S. 1973,30-28-101 (10) (a)-(d), as amended; and
NOW TIIEREFORE, BE IT RESOLVED that the division of the above described
