EXEMPTTON APPLTGABTLTJY Purzuant to section B:50 of the Subdivision Regulations, the Board of County Commissioners has the discretionary power to exernpt a divlsion of land from the definition of subdivision and, thereby, from the procedure in these Regulations, provided the Board of County Commissioners determines that such exemption will not impair or defeatthe stated purpose of the Subdivision Regulatlons nor be detrimental to the general public welfare. The Board has determined that leases, easements aM other similar interests in Garfield County owned property, land for oil and gas facilities, and an accessory dwelling unit or two family dwellirg that are subject to leasehold interest only and complying with the reguirements of the Garftetd County Zoning Resolutlon, are exempt from these regulations. The Cushman soil is on the landscape where alluvium has accumulated to a greater depth over bedrock, and the Lazear soll is on the steeper areas. Cushman soil is moderately deep and well-dreined. The surface layer is stony loam about 3 inches thick- The subsoil is sandy loam about I inches thick. The substralum is loam and very gravelly loam. Shale and sandstone are at depth ot 32 inches. APPLICANT has submitted to COUNTY an application for t ' nO {n.,^{ 4 ',,N(hereinafter, THE PROJECT). 2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended, establishes a fee schedule for each tlpe of subdivision or land use review applications, and the guidelines for the administration of the fee structure. 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional payments upon notification by the COTINTY when they are necessary as costs are incurred. 4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of consulting service determined necessary by the Board of County Commissioners for the consideration of an application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs exceed the initial Base Fee, APPLICANT shall pay additional billings to COLINTY to reimburse the COUNTY for the processing of the PROJECT mentioned above.
