EASEMENT AGREEMENT
THIS AGREEMENT made and entered into as of theZc) auy of , /ott , 2003,
by and between David W. Maves whose address is 1445 Castle Court, Fruita, CO 8l 521 (hereinafter
referred to as "Grantor") and Richard J. Murr, whose address is37659 Highway 6, New Castle, CO
81647(hereinafter referred to as "Grantee"). In consideration of this Agreement and the granting
of the easement hereinafter set forth, it is agreed as follows:
l. Grantor grants and conveys to Grantee an easement for utilities, ingress and egress as
described on Exhibit A attached hereto and incorporated herein by reference. This easement
is appurtenant to that real property owned by Grantee identified as Garfield County
Assessor'sParcelNo.218l-061-00-183 andsituatedinLot l,portions ofLot2,andportions
of the Sl/2 NEl/4 and NEl/4NEl/4NWll4SEll4 of Section 6, Township 6 South, Range
91 West of the 6th P.M .
2. The easement is for use by Grantee, his successors, assigns, agents, employees, tenants,
guests and invitees, jointly, subject to the terms, conditions, and provisions hereinafter set
forth.
Any new construction in the easement area shall not negatively affect the current drainage
flow on the easement.
Neither parfy may utilize gates, relocate any fence, or otherwise impede access over or across
the easement area.
The easement granted and conveyed, and the provisions herein shall survive to the parties'
assigns, heirs and successors.
Grantor represents and warrants that, at the time of the granting of the above easement and
the entering of this Agreement, he is the owner of the property subject to this easement and
has the right to grant, bargain, sell and convey this easement, and enter into this Agreement.
The parties acknowledge and agree that they have incorporated into this Agreement their
entire and full agreement and understanding. No statement, oral or written, not incorporated
herein shall have any force or effect whatsoever. Neither party is relying on any
representations of the other party other than those set forth herein.
The parties agree that this Agreement shall not be modifiable except by its own terms, or by
operation of law, or by the written agreement of the parties.
This Agreement shall be construed and governed in accordance with the laws of the State of
Colorado. Should a dispute arise between the parties in regards to this Agreement, or should
either party employ an attorney to enforce their rights, title and interest under this Agreement,
the prevailing party shall be awarded reasonable afiomey's fees and costs incurred therein.

AFFIDAVIT AND NOTICE REGARDING
BOUNDARY LINE ADJUSTMENT
The undersigned being first sworn upon thereof, depose and state as follows:
1. We are the owners of certain parcels of real property in the unincorporated area of
Garfield County, which are described in Exhibit A attached hereto and incorporated herein by this
reference.
2. We are desirous of adjusting the boundary lines of our parcels and sign this Affidavit
and Notice in accordance with the Garfield County Subdivision Regulations of 1984.
3. We hereby represent that no new parcels will be created and, therefore, that Garfield
County will not be required to issue any building permits, other than what it would be required to
issue for the already existing lots.
4. We hereby represent that none of the parcels of property involved in this boundary
line adjustment is part of a previously platted subdivision of record.
5. We hereby represent that the boundary line adjustment made reference to herein will
not cause the loss of access by road or to utilities to any parcel of property involved.
6. We hereby authorize Garfield County to record a copy of this Affidavit with the
Garfield County Clerk and Recorder, and to fumish this Affidavit to the Garfield County Assessor.
