WHEREAS, Robert and Naomi Mayo have petitioned the Board of County Conrnissioner of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" nnder C.R.S. L973, 30-28-101 (10) (a)-(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, L979, Sections 2.02.2L (d) and 3.02.01 for the divisionof an 86 acre tract described as follows: that parcel of land as described in Document No. 289633 asfiled in the Office of the Clerk and Recorder of Garfield County, Colorado into 2 tracts of approximately 20 and 66acres each, more or less, which proposed divided tractis more particularly described as follows: Tract A: All the real property described as "Sli\Inl]..NV'1f; Section 25, Tovrnship 5 South, Range 9l llest of the Sixth Principal Meridian together with an access through part of the EL" NWZ Section 25, Township 5 South, Range 9l West of theSixth Principal Meridian, said access described as follows: Beginning at the North Quarter Corner gf said Section 25,a iebar Ind cap in place, thence S. 89038'13"W., L325.52feet along the Northerly line of said Section 25; thenceS.00oI5'35"E., 30.00 feLt ro a poinL of rhe Sourherly lineof said Cor:nty Road, the True Point of Beginning; thenceN.B9o34'49"8.-,50.00 feet along the Southerly line of said County Road; then S. 00o15'35"E. , I000.00 feet; thence S.89o38"13"W. 50.00 feet to a point on Lhe Easterly lineof the NW,"NWL of said Section 25; thence N. 00oI5'35"W. 1000.00 feet along the Easterly line of the NI,TIZNW'< ofsaid Section 25 to a point on the Southerly right-of-wayof said County Road, the True Point of Beginning. Tract B: The remaining 66 acres (in the State of Colorado and County of Garfield); and I^IHEREAS, the Petitioners have demonstrated to the satisfactionof the Board of County Commissioners of Garfield County, Colorado,that the proposed division does not fall within the purposes ofPark l, Article 28, Title 30, Colorado Revised Statutes L973, as amended, for the reason that the impact created does not warrantfurther subdivision review. -Tt* WHEREAS, the Petitioners have demonstrated to the satisfactionof the Board of County Commissioners of Garfield County, Coloradothat there is a reasonable probability of Iocating domestic wateron each of said tracts, that there is adequate in[ress and egreeto said tracts, that the location of septic tanks will be permittedby the Colorado Department of Health, that the requested divisionis not Part of an existing or Larger development and does not fallwithin the general purposes and intent of the subdivision regulationsof the state of colorado and the county of Garfield, and sho[ld,therefore, be exempted from the definition of the terms "subdivision"and "Subdivided land" as set forth in c.R.s. L913, 3o-28-r0l (a)-(d),as amended; NOW, THEREFORE, BE IT RESOLVED that the division of the abovedescribed tracts "A", "B", from the above described 86 acre tract il hgrgby exempted from such definitions and said tract may bedivided into tracts "A", "B", all as is more furly described above,and said divided tract may be conveyed in the form of such smallertracts wirhout further compliance with the aforesaid subdivisionstatutes and regulations; provided, however, that this exemptionis granted on the condition and with the express understanding andagreement of the Petitioners that no furthei exemptions be allowedon said tracts "A", "B", and that a copy of the instrument orinstruments of conveyance when recorded shall be filed with this Re s ol ut ion -/./Dateci this //l'^"d,ry of May , Lg82.
