RSSOLUTION NO.82-05
A RESOLT]ITION CONCERNED WITH GRAIIIING AN E)G}4PTION FROM THE GARFIELD COI]NTY SIEDIVISION
REGULATIONS FOR DELLA I'IARTIN.
WHEREAS, Del1a Martin has petitioned the Board of County Commissioners of GarfieldCounty, Colorado, for an exemption from the definition of the terms "subdivision,' andfrsubdivided land" under c.R.s . L973, 3o-28-l0r (10) (a)-(d), as amenc16d, and theSubdivision Regulations of Garfield County, Colorado, adopted January 2, lg7g, SecEions2:02.21 (d) and 3.02.01 for the division of a 80 acre tract describeC as follows:that parcel of land as described in Document No. 167898 as filed in the Office of theClerk a.nd Recorder of Garfield County, Colorad.o into 2 tracts of approximately 2 and78 acres each, more or 1ess, which proposed divided tracts are nore particularly describedas follows:
TracE A: an access easement for a private road across the N#4Ngl6, Seetion 20, T7S,
.R95Wr 6th Principal Meridian ln Garfield County, Colorado. Said access
easement shall be a-total of 30.0 feet wide, being 15.0 feet on each sid.eof the following described centerline:
Beginning at a point on the north line N[,IkNEk, Section 20, T7S, R95W whencethe NE corner of ULITaNFft Section 20 bears EaFt a distance of 31.6 feet:1. lfhence S.O6o53r'E. a distance of L37.4 feet;2. Thence S . 28 "4 5'rW. a disrance of 169 .0 f eet :

Tract. B: the remaining 78 acres
(in the State of Colorado and County of Garfleld); and
IIIIEREAS, the Petitioner has demonstrated to the satisfaction of the Board ofCounty Conrnissioners of Garfield County; Colorado, that the proposed divislon does notfall within the purposes of Part 1, Article 28, Title 30, Colorado Revised StatutesL973' as amended, for the reason that the impact created does not warrant furthersubdivision reviewr fnd.
I^IIIEREAS, the Petitioner has demonstrated to the satisfaction of the Board ofCounty Commissloners of Garfield County, Colorado, that there is a reasonable probabilityof locating domestic water on each of said tracts, that there is adequate ingress andegress to said tracts, that the location of septic tanks will be permitted by the ColoradoDepartment of Health, that the requested division is noE part of an existlng or larger
development and does not fall within the general purposes and intent of the sub6ivisionregulations of the State of Colorado and the County of Garfield, and should, therefore,be exempted from the definition of the Eerms "subdivision" and "subdivirled land,' ,a ""tforth in C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended;
