RESOLDTION NO 07- 22
A RESOLUTION CONCERNED WITH REPEALING RESOLUTION NO. 82-05 THAT
GRANTED AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION
REGULATIONS .FOR A 2.07 ACRE PARCEL OWNED BY DELLA MARTIN.
WHEREAS, Garfield County is a legal and political
subdivision of the State of Colorado for which the Board of
County Commissioners is authorized to act; and
WHEREAS, on January 4, 1982, the Board of County
Commissioners adapted Resolution No. 82-05(attached as Exhibit A
and incorporated herein), which granted an exemption from the
Garfield County Subdivision. Regulation separating a 2.07 acre
tract A. from a then existing 80 acre parcel as legally described
in Resolution 82-05; and
WHEREAS, on October 11, 2000, the Personal Representative
for the Della Martin estate separated the 80 acres into two 40
acre parcels through a Deed of Distribution by Personal
Representative. One of the parcels was deeded in an undivided
one-half interest to Marl M. Martin and Patricia Martin as JTWROS
("Assessor's Parcel 170" and an undivided one-half interest to
Mickey M. Martin and the other 40 acre parcel was deeded in an
undivided one-half interest to Melba M. Carpenter and Darold J.
Carpenter as JTWROS and an undivided one -.half interest to Gail L.
Martin ("Assessor's Parcel 178 &179").
WHEREAS, on May 20, 2002 the Board of County Commissioners
adopted Resolution No. 2002-72 that granted an exemption from the
Garfield County Subdivision Regulations separating the Carpenter
and Martin 40 acre tract into two 20 acre lots, Assessor's Parcel
178 & 179.

WHEREAS, Marl and Patricia Martin and Mickey Martin, applied
for an exemption from the Garfield County Subdivision Regulations
requesting a separation of the 40 acre parcel, Assessor's Parcel
170, into two 20 acre parcels. A hearing before the Board of
County Commissioner was held on this request March 20, 2006; and
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Garfield County, as follows:
1. In the March 20, 2006 hearing requesting a split by
exemption from the Garfield County Subdivision Regulations on
Assessor's Parcel 170, a title commitment was submitted as
evidence that showed the 2.07 acre parcel known as tract A
exempted from the Garfield County Subdivision Regulations in
Resolution No. 82-05 had clever been conveyed or created.
2. Resolution No. 82-05 should be and hereby is repealed.
