BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
RESOLUTION NO. 79-29
WHEREAS, Lee Martens has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption from the definition of the
terms 11 subdivision 11 and 11 subdivided land 11 under C.R.s: 1973, 30-28-101 (10)
(a)-(d), as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the
division of a 6.0 acre tract described as follows: A parcel of land in
the SW1~NE~ of Section 10, T.6S., R. 93W. of the 6th P.M. into 2 tracts of
approximately 3.0 acres each, more or less, which proposed divided tracts
are more particularly described as follows:
Tract A: A parcel of land in the SW~ of the NE~ of Section 10, T.6S.,
R. 931~., of the 6th Principal Meridian more particularly described as
follows: Beginning at the S.E. corner of the S.W. ~of the N.E.~ of
said Section 10, a stone monument found in place, thence North 258. 77
feet and along the westerly right of way line of County Road No. 293,
to the true point of beginning thence West 505.00 ft.; thence North
258.77 ft.; thence East 505.00 ft.; thence South 258. 77 ft.; and along
the westerly right of way line of County Road No. 293, to the true
point of beginning, said parcel containing 3.00 acres, more or less.
Tract B: A par9el of land in the SW~.of the NE~ of Section 10, T.65.,
R.93W. of the 6th Principal Meridian more particularly described as
follows: Beginning at the S.E. corner of the S.W.~ of the N.E.~ of
said Sec ti on 10, a stone monument found in pl ace, thence North 517. 54
ft. and along the westerly right of way line of County Road No. 293,
to the true point of beginning thence \~est 505.00 ft.; thence North
258.77 ft.; thence East 505.00 ft.; thence South 258.77 ft. and along
the westerly right of way line to the true point of beginning, said
parcel containing 3.00 acres, more or less in the State of Colorado and
County of Garfield; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that there is
a reasonable probability of locating domestic water on each of said tracts,
that there is adequate ingress and egress to said tracts, that the location
of septic tanks will· be permitted by the Colorado Department of Health,
that the requested division is .not part of an existing or larger development
and does not fall within the general purposes and intent of the subdivision
regulations of the State of Colorado and the County of Garfield, and should,
therefore, be exempted from the definition of the terms 11 subdivision 11 and
11 subdivided land 11 as set forth in C.R.S. 1973, 30-28-101 (10) (a)-(d), as
amended;

exempted from.such definitions arid said tract may be di'vided into tracts 11 A11 ,

conveyed in the form of such smaller tracts without .further compliance with

and agreement of the Petitioner that no further exemptions be allowed on said

conveyance when recorded shall be filed with this Resolution.
