WHEREAS, MILDRED K. MAUGHAN, has petitioned the Board of County_ Commissioners of
Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10)
(a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado,
adopted September l, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01,
for the division of a 15.25 acre tract of· land into two tracts of 8.25 and 7 acres,
more or less, and said 15.25 acre tract more particularly described as follows:
Located in the NE~SE~ of Section 36, T5S, R93W of the 6th P.M., Garfield
County, Col or ado and irore particularly described as fo 11 ows:
Commencing at the SE car. of said Sec. 36; thence Nqrth 2253.12 feet;
thence West 497.94 feet to the TRUE POINT OF BEGINNING and the Westerly
ROW fence of State Highway No. 13; thence S ooo 44 1 W along said fence
813.14 feet; thence West 811.66 feet; thence N 00° 01 1 30 11 W 813.32
feet; thence S 390 59 1 E 822.42 feet to the POINT OF BEGINNING; and
containing 15.25 acres, rrore or less. ·
\mEREAS, the Petitioner has demonstrated to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that she desires said exemption
for the purpose of re-sale into-single-family residential acreage; and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of t.he Board that there
is a reasonable probability of locating domestic water on each of said tracts, that
there is adequate ingress and egress to said tracts, that the location of septic tanks
w1ll be permitted by the Colorado Departn~nt of Health, that the requested division
is in accordance with the general purposes and intent of the Subdivision Regulations
of the State of Colorado and the County of Garfield and should, therefore, be exempted
from the definition of the terms 11 subciivision" and "subdivided land" as set forth in
C.R.S. (1973) Section 30-28-101 (10) (o.) -(d) as amended;

Flaven J. Cerise and carded, said 15.25 acre tract of land is hereby ---'------------
exempted from such definition and transfer of s·aid tract may be made by division into
two ·cracts of 8.25 and 7 acres, more or less all as is more fully described above, and
:urt.her, that said exemption is conditioned upon the Petitioner obtaining a proper ..
·je9c.l description of said tracts prior to any conveyance thereof. A copy of the
instr~@ent(s) of conveyance when recorded shall be filed with this Resolution.
