The Application has been reviewed in accordance with the Land Use and Development Code including Section 6-203 PUD Zoning Amendment. Said provisions require a Decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision on following findings: 1. That proper public Decision. r the CMC Minor PUD Modification is based on the notice was provided as required for the Director's 2. That consideration by the Director was extensive and complete, that al! pertinent facts, matters and issues were submitted or could be submitted and that all interested pafties were provided the opportunity to have input on the request. 3. That for the above stated and other reasons, approval of the Minor PUD Modification request by the Colorado Mountain Junior College District is in the best interest of the health, safety, and welfare of the citizens of Garfield County. 4. That the Minor PUD Modification has been determined to be in general conformance with the Comprehensive Plan 2030, as amended. 5. That subject to compliance with conditions of approval the Minor PUD Modification is in conformance with the Review Criteria contained in Section 6-203(C), Review Criteria of the Garfield County Land Use and Development Code, as amended. The Director's Decision is hereby issued approving your Application for a Minor PUD Modification for the CMC PUD to add Telecommunication Tower as a permitted use in the PUD Guidelines subject to the above findings and the following conditions: 1. That all representations made by the Applicant in the Application shall be conditions of approval unless specifically altered by the conditions of approval contained herein. 2. That the Applicant's proposed PUD Text shall be modified to include provisions related to compliance with all applicable regulations governing this type of use, Location and Extent Review, and tower designs that lessen visual impacts. The Text shall be amended to read as follows subject to final review and approval by the County Attorney's Office. Permitted Use. The construction and installation of one (1) telecommunication tower, not to exceed seventy (70) feet, shall be permitted by right with no further review by Garfield County, subject to the following standards: A. That the Facility shall be operated in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility including any FCC and FAA regulations. B. That the location of the facility shall be subject to County Planning Commission Location and Extent Approval and any representations contained in said application. 3. That the original CMC PUD Guideline and Amended PUD Guideline shal! be recorded with the Gadield County Clerk and Recorders Office. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on July 23'o. Following the expiration of the call-up period you can proceed with meeting the conditions of approval and the recording of the amended PUD Guideline including the revisions to the permitted uses. The amended PUD Guideline needs to be recorded within 30 days of the date of the Director's Decision. 2 Please contact the Community Development Department if you have any questions regarding the Director's Decision and the next steps for finalizing your Minor Modification to the PUD. The Board of County Commissioners of Garfield County approved the Colorado Mountain College Planned Unit Development on September 22,1975 (the "PUD"). 2. The PUD included 621acres owned by Colorado Mountain College a/k/a Colorado Mountain Junior College Disfrict ("CMC") to be used for the principal use to support a community college, including but not limited to building of classrooms, Iaboratories, teaching and administrative offices; strldent recreation, social and housing; learning center and ancillary buildings for college mainten{nce. The legal description of the PUD is attached hereto as Exhibit A and incorporated by reference. 3. The PUD also includeN five acres sold to a private commercial developer for the construction of apartment buifdings. 4. The proposed uses wiftin the PUD were Educational Facilities, Student Apartments and Common Open Space accordifrg to the original PUD Application attached hereto as Exhibit B and incorporated by reference ("PUD Application"). 5. CMC submitted to Galfield County an application for a Minor Modification to the PUD to allow for a telecommunicaflon facility. 6. On July l3,20l5,the pirector of the Comrnunity Development Department approved the request for a Minor Modificatlon to the PUD with certain conditions (the "Director's Decision"). 7. CMC is amending the existing uses within the PUD consistent the Director's Decision. 8. CMC hereby amends the PUD to include the following permitted use under the Proposed Uses outlined in the PUD Application: Permitted Use.
