DECLARATION AND AGREEMENT is made on March L9,
MAZUCHI and JUDY A. MAZUCHI, the owners in fee of
and 3, Mazuchi S.B. 35 Exemption P1at, recorded as
in the office of the Garfield County
Clerk and Recorder,and by Thomas W. Stuver.
IT IS DECI,ARED AND AGREED THAT:
1. The owners of Parcels L,2, and 3 sha11 own, in
equal shares, and as tenants in conmon, that ncnexclusive utility
and access easernent running in and upon the easterly 25 feet of
Antlers Orchard Development Tracts L5,18, and 31, and in and upon
the westerly 25 feet of Antlers Orchard Development Tracts A6, L7,
and 32 as shown on the recorded plat of the Mazuchi S.B. 35
Exemption. Such easement has been reserved in deeds recorded in
Book 682 at Page 650, in Book 687 at Page 692, in Book 693 at
Page 546, and in Book 751-, at Page 948.
2. The owners of Parcel 1 shall own that nonexclusive
utility and access easement running in and upon the North 25 feet
of said Parcel 2, and in and upon the South 25 feet and the
Southeast Corner of the Antlers Orchard Tract 3L as shown on the
recorded plat of the Mazuchi S.B. 35 Exemption.
3. The cost of constructing and maintaining roadways
within said easements shall be borne by the owners of the
respective parcels served in equal shares; the owners of Parcels
L,2, and 3 being egually responsible for the construction and
maintenance of the roadway in the easement identified in paragraph
L, above; and the owner of Parcel 1 being solely responsible for
the construction and maintenance of any roadway in the easement
described in paragraph 2, above.
4. In the event the owners cannot agree upon the
amount of maintenance to be performed, or the cost incurred for
such maintenance, the owner performing the maintenance may recover
the reasonabte expense of maintaining reasonable access in a civil
action for contribution, or such other Iega1 remedy as may be
appropriate.
5. The agreements herein set forth are without
prejudice to the rights, if dtry, of the owners of Parcels 1, 2,
and 3, to seek such reasonable contribution as may be appropriate
for the maintenance of roadways in the nonexclusive easements,
from the owners of the Antlers Orchard Development tracts who
utilize such easements.
6. This Dectaration and Agreement shall be binding
upon the parties, their heirs, personal representatives, and
assigns, and is intended to establish covenants and rights running
with the ownership of the parcels of land subject hereto.
7. Thomas W. Stuver joins in this declaration for the
sole purpose of confirming the easements set forth in paragraphs
1 and 2, above.
