exemption plat. Enclosed are Board of County Commigsioners minutes and a

Chuck discussed the stalL agreenrents at the FairgrounCs anC the signing of
these agreement by tee I'icss, FairgrounCs I'lanager, on behalf of the
Conrnissioners due to the time factcr involveC in scheCuling the stalls. Chuck

PEST AND WEED MAI.iAGER
Chuck discussed the need to advertise fcr a new rrnnager of the Pest and Weed
control and the Board directed that the Pest and WeeC Board see that this is
done but they wanted tc lock at the final applicants.
I.,ANDFILL FEE WAIVER FOR FAIRGRCXJI\D II,ASTE
Chuck discussed the request from Lee Moss, Fairgrounds Manager, for a waiver
IanCfiII fees tc clean up the Fairgrounds after activities. The Board agreed
to waive the fees for the waste at the Fairgrounds.

There was a discussion with Chuck regarding the South Canyon Landfill bills
from the Town of CarbonCale and Tim Danner for the free dump day in April. Tim
Danner had additional unanticipatei expenses from it due to having to bring in
his dozer operator for an aCCitionat 5150 totaling his bill to $275.00.
Conrnissioner Smith made a motion that the bill from Tim Danner for 5275.00 for
the landfill fees be paid. Ccmmissicner Schmueser seconded the motion;
carried. The Carbondale biII haC been approved and Chuck was directed to write
a thank you letter to both for their services.
There was a discussion regarding an aiditional S1000.00 being put into the
budget each year for this annual event on the last Saturday of each April and
Chuck was directed to make this a part of the budget for 1989.
PUBLIC MEETING FOR A SUBDIVISION EXEMPTION REQUEST LCCATED APPROXIMATELY I MILE
NORTH OF SILT OFF COUITIY ROAD 214; APPLICANI, JIM AIID JUDY MAZUCHI
Gary Berschauer, 0379 Panoramic Dr., Silt, represented the applicants.
Assistant Attorney Sherry CaIoia discussed the public notices and the Board
found that the legaI conditions were met adequately. County Planner Glenn
Hartrnann reviewed Ehe staff corments and discussed an amendment to condition #2
and an additional condition. There was a discussion with lvlr. Berschauer
regarding the applicants'approval of the amended and added conditions and Mr.
Berschauer stated he felt the applicants would not object to the amendments and
agreed to proceed.
There was considerable discussion with Assistant Attorney Caloia regarding the
statutory requirement that access be established prior to approval and Chairman
Richardson explained that the approval was actuaIIy contingent upon this
establishment and it would have to be proven before final resolution of
approval or signing of the plat which is reviewed by the attorney's office.
Ms. Caloia also discussed the tarater supply with Mr. Berschauer and the

necessity of filing amended weII permits to make sure the acreage corresponds
with the Lot. Theie was a discussion regarding whether the applicants wouLd
want to proceed with this condition or schedule another meeting. Gary
Berschauer felt they would want to go ahead with the hearing.
Connnissioner Smith made a motion that the Subdivision exemption request oE Jim
and Judy Mazuchi, located approximaEely I mile north of Silt off County Road
214 be approved according to tne staff comments dated May 23, 1988 wiLh
condition No. 2 amended to read: "That the applicant submit proof of legal
access to the proposed lots and that a legally described access easement. from
County Road 50b A to each of the proposed lots _be included on the exenption
p[at.;', that condition No. 3 be stressed regarding the submiEting of -'vidence
if tf,".dornestic source of water for each of the proposed lots consisting of
additional well permits or other verification deemed acceptable' and that an
added condition iNo. B) be: "That the applicant establish a horneowners
association covenant or other acceptable legal means for administering the
construction and maintenance of the access easement from the County Road to the
proposed lots and in addition a driveway access permit shall be obtained from
Lhe-County Road & Bridge Department as required." Commissioner Schmueser
seconded the motion; carried.

Eric Walter of Petre & Petre, 110 8th St., Glenwood Springs, attorney for the
applicant and applicant James Stephens, Gypsum, were present. Assistant
allorney Sherry baloia discussed the notices with them and stated to the Board
that thi public notices were adequate. County Planner GLenn Hartmann reviewed
the staff comments and after discussion regarding the water supply,
Commissioner Smith made a motion that the subdivision exenption request of
James Stephens be approved with the conditions in the staff report dated May
23,1988 ;ith an aaOeO condition that the 9 l/2 acre parcel not be counted
toward the four-Iot limit on the subdivision exentptions because it is naturalLy
separated from the resE of the subdivision.
After discussion regarding condition No. 3 and an adjustment for the School
Inpact fee, Commissioner Smith made a motion that the Board approve the
srbdivision exenption request by James Stephens with the recommendations within
the staff conrnents dated May 23, 1988 with condition No. 3 stating the
applicant subrnit an appropriate school irnpact fee instead of 5200.00 and the
aaOed condition No. 5 that the 9.5 acre parcel not be counted toward the
fcur-lot limit on the subdivision exemption due to its natural separation from
the other exemptions. Ccmmissioner Schmueser seconded Ehe notion; carried.

and explaineC how these ccncerns have been aCCresseC stating that the lccaticn
on section 26 has been posLpcneC inCefinitely Cue to citizen concern.
Kathleen Buf f ington, member cE the homeovgner's association, !,ras concerned with
the well in section 26 and ask what he rneant by "inCefinitely". He stateC that
if the well was ever considereC again, the President of the homeowners
association wiLl be notified. She stateC some hcmeowners were concerneC that
the wells were not exactly where they were prcposed to be and asked hcw much
