Pursuant 1o C.R.S. (1973) Section 30-28-l0l (10) (a) - (d) as amended, and the
Subdivision Regulations of Gar[ield County, Colorado, adopted Ap.il 23,1984 Section 2:20.49,

SUBMITTAL REQUIREMENTS:
An application which satisl-res the review criteria must be submitted with all the following

Sketch map at a minimum scale of l"=200' showing the legal description of the
property, dimension and areaofall lotsorseparateinterests to becreated, access
to a public right-of-way, and any proposecl easements for drainage, irrigation,
access or utilities;
Vicinity map at a minimum scale of l"=2000' showing the general topographic
and geographic relation of the proposed exemption to the surrounding area
within two (2)miles, forwhichacopy of U.S.G.S. quadrangle mapmaybeused.
Copy of the deed showing ownership by the applicant, or a letter from the
property owner(s) if other than the applicant; and
Names and addregses of owners of record o!!ining and
within 200 feet of the proposed exemption,mineral
owners of record of the property to be exempted, an<ftenants of any structure
proposed for conversion; and
Evidence of the soil types and characteristics of each type; and
Proof of legal and adequate so)re\of domestic water for each lot created,
method of sewage disposal, an(leffa:Jof approval of fire protection plan from

If connection to a community of municipal water or sewer system is proposed,
a letLer from the governing body stating a willingness to serve; and
Narrative explaining why exemption is being requesl.ed; and
It shall be demonstrated that the parcel existed as described pn January 1,1973
or the parcel as it exists presently is one of not more than three parcels created
from a larger parcel as it existed on January 1,1973.

APPLICABILITY
The Board of County Commissioners has the discretionary power to exempt a division of land
from the dehnition of subdivision and thereby liom the procedure in these Regulations,
provided the Board determines that such exemption will not impair or defeat the stated purpose
of the Subdivision Regulations nor be detrimental to the general public welfare. The Board
shall make exemption decisions in accordance with the requirements of these regulations.
Following a review of the individual facts of each application in light of the requirements of
these Regulations, the Board may approve, conditionally approve or deny an exemption. An
application for exemption must satisfy, at a minimum, all of the review criteria listed below.
Compliance with the review criteria, however, does not ensrue exemption. The Board also may
consider additional factors lisl.ed in Section 8:60 of the Subdivision Regulations.
A.No more than a total of fouf (4) lots, parcels, interests or dwelling units will be created
from any parcel, as that parcel was described in the records of the Garheld County
Clerk and Recor<ler's OIfice on January l, 1973, and is not a part of a recorded
subdivision; however, any parcel to be divided by exemption that is split by a public
right-of-way (State or Federal highway, County road or railroad) or natural feature,
preventing joint use of the proposed tracts, and the division occurs along the public
right-of-way or natural feature, such parcels thereby created may, at the discretion of
the Board, not beconsidered to have been created by exemption with regard to the four
(4) lot, parcel, interest or dwelling unit limilalien otherwise applicable;
All Garfield County zoning requirements will be met; and
All lots created will have legal access to a public right-of-way and any necessary access
easements have been obtained or are in the process o[being obtained; and
Provision has been madefor an adequate source of water in terms of both the legal and
physical quality, quantity and dependability, and a suitable type of sewage disposal to
serye each proposed lot; and
All state and local environmental health and safety requirements have been met or are
in the process of being met; and
Provision has been made for any requirecl road or storm drainage improvements; and
Fire protection has been approved by the appropriate fire district; and
Any necessary drainage, irrigation or utility easements have been obtained or are in the
process of being obtained; and

PROCEDURES
A. A request for exemption shall be submitted to the Board on forms provided by the
Garheld County Department of Development/Planning Division. Two (2) copies of the
application maps and supplemental inlormation shall be submitted.
B.ThePlanning Divisionshall reviewtheexemption requestforcompleteness withineight
(8) days of submittal. If incomplete, the application shall be withdrawn from
consideration and the applicant notified of the additional information needed. If the
application is complete, the applicant shall be notified in writing of the time and place
of the Board of County Commissioners meeting at which the request shall be
considered. In either case, notification shall occur within lilteen (1 5) days of submittal.
Notice of the public meel.ing shall be mailed by certified mail, return receipt requested,
to owners of record of land immediately adjoining and within 200 feet of the proposed
exemption, to mineral owners and lessees of mineral owners of record of the land
proposed for exemption, and to tenants of any structure proposed for conversion. the
exemption site shall be posted clearly and conspicuously visible from a public right-of-
way with notice signs provided by the Planning Division. All notices shall be mailed at
least fifteen (15) and not moTe than thirty (30 days prior to the meeting. The applicant
shall be responsible for mailing the notices and shall present proof of mailing at the
meeLing.
At or within fifteen (15) days of the meeting, the Board shall approve, conditionally
approve or deny the exemption request. The reasons for denial or any conditions of
approval shall be set forth in the minutes of the meeting or in a written resolution. An
applicant denied exemption shall follow the subdivision procedure in these regulations.

This well shall be used in such a way as to cause no materiat injury to existing water rights. The issuance d the
p€rmit does not assure the applicant that no aniury will occur to another vested water light or preclude andher
orvner of a vested water right from seeking rellef in a civil court action.
The construction of this well shall be in compliance with the WaterWell Construction and Pump lnstallation Rules
2 CCR 402-2, unless appro/al of a varianco has been granted by the State Board of Examiners of Water Well
Construction and Pump lnstallation Contractors ln accordance with Rule 17.
Approred pursuant to CRS 37-92602(3)(bXlXA) as the only well on a tract of land of 68.86 acres described as
Garlield County, being more particularly described on the attached exhibit'N.
The use of ground water from this well is limited to fire protection, ordinary household purposes inside three (3)
single family dwellings, the irrigation of not more than one (1) acre of home gardens and lawns and the watering
of domestic animals.
The maximum pumping rate shall not exceed 15 GPM.
The return flow from the use of this well must be through an individual waste water disposal sysilem of the
non-€r/aporative type where the water is retumed to the same strean system in whlch the well is located.
This well shall be constructed not more than 200 feet from the bcaion specified on this permit.

deep, well-drained soil is on mesas, benches, and sides
of valleys. This soil formed in mixed alluvium derived
primarily from basalt. The surface layer is stony loam
about 8 inches thick. The underlying material is very
strongly calcareous very stony loam to a depth of 60
lnches. Permeability is moderately rapid, and
available water capacity is low. Effective rooting
depth is more than 60 inches. Runoff is rapid, and the
erosion hazard is high.

Dear Mark:
We have review the above referenced subdivision exemption to be located east of the
Town of Silt. The applicant proposes to split a 63+ acre parcel into four parcels of 43, 10, 5, and
5 acres each. An existing well permit, no. 183128, is proposed to be used to serve three of the
parcels. A new well, augmented with a water allotment contract from the West Divide Water
Conservancy District (District), is proposed to serve the fourth parcel.
Permit no. 1 83128 was issued on Novemb et 4,1994, and is currently valid until November
4, 1996. The use of this well is limited to the ordinary household purposes inside three single
family dwellings, the irrigation of not more than one acre of home lawns and gardens, and the
watering of domestic animals. This permit will remain valid if the well is constructed prior to the
expiration date and as long as the well is operated pursuant to the permit's conditions of
approval.
A permit for a second well to serve the fourth parcel would be available (in accordance
with the requirements of Section 37-90-137(2), C.R.S.) upon application to this otfice and upon
submission of a executed water allotment contract with the District. The operation of the well
would be subiect to the terms of the District's Substitute Water Supply Plan. Diversions from the
well could not exceed the acre-foot amount of the applicant's water allotment contract. lt would
be helpful if the applicant identified which parcels are to be served by permit no. 1831 28, and
which parcel is to be served by the proposed new well.

Mazuchi SB 35 Exemption
After the continued hearing ot2l6l95, Mr Mazuchi's application was referred to the Town of
Silt for comment. No written comment has been recieved, but the Town Administrator has
verbally indicated that he would be at the meeting on Monday. At the last meeting, it was
recommended that the following conditions be added to those already in the staff report:
Approval from the Bureau of Reclamation for the new crossing of the Farmers
Irragation Ditch.
Agreements from the other ditch companies for all of the other new crossings.
In response to the concerns about the grade of the road and the need for building envelopes
with slopes less than 40o/o, the enclosed information was submitted. (Se pgs.il-h\ Staff is
concerned about the fact that the new documents show a different configuration of the property
than the original submittal. There is an area excluded from the new maps that was previously
shown as being aputof the property to be exe,mpted. If this property is to be excluded from
the application, some documentation needs to be presented to the County Attorney for review
and it will also be necessary to determine whether ornot the appropriate legal description was
used for the notice sent to property owners within 200 ft. and mineral rights owners. If this
property is excluded, it will also be necessary to create an access easement for the perpetual use
of any property owner of an exempted parcel. The road grade map shows grades in excess of
l4%o, which is the maximum allowed by the County Subdivision regulations. This will need to
be corrected prior to the approval of any plat.
In summary, there is no response to the previously noted issues regarding the diches, theremay
be a need to readvertise the meeting due to a change in boundaries of the application and the
road grades need to be addressed. There appear to be enough questions that stitl need to be
answered, that this application should be continued to another date, if it is not necessary to
notice the meeting due to the change in the configuration of the application.

It is the responsibility of the permittee to complete the construction of the access.according to the terms and conditions of
the permit. ll the permittee wishes to use the'access prior to completion, arrangements must be approved by the issuing
authority and Department and included on the perinit. The Department or issuing authority may order a halt to any
unauthorized use of the access. Reconstruction 6r improvements to the access may be required when the permittee has
failed to meet requireJ sfecitications of design or materials. lf any construction element lails within two years due to
improper construction or'material specifications, the permittee is responsible for all repairs.
ln the event it becomes necessary to remove any right-of-way fence, the posts on eitherside of the access shall be securely
braced with an approved ena poit bef ore the tenciis cut to prevent any slacking of the remaining fence. All posts and wire
removed are Department property and shall be turned over to a representative of the Department.
A copy of the permit shall be available for review at the construction site. lf necessary, minor changes and addltions shall be
orOered by the Department or local authority field inspector to meet unanticipated site conditions.
The access shall be constructed and maintalned in a mannerthat shall not cause water to enter onto the roadway, and shall
not interfere with the drainage system ln the rlght-of-way.

1 . lf there are changes in the use of the access, the access permit-issuing authority must be notlf ied of the change. A change in
property use which makes the existing access design br use ln non--conlormance with the Access code or the terms and
conditions of tne permit, may require ilie reconstruct-ion or relocation of the access. Examples ol changes ln access use are;
an increase in vehicular votume by 20 percent, or an increase by 20 percent of a directional characteristic such as a lelt turn'

add the following restrictions if thjs exemption is approved.
No building or structure including power or telephone poles be
constructed such that they w'i11 be v.'isible on the skyline of DavisPoint from either the east or west direction lookjng towards
Davis Point.
Restrjct'ions on all lots be placed on the final ptat to the effectthat of the three irrigation ditches that cross the 63 acres a
minimum of 20 feet between the edge of any ditch and any structureor fence be left open for access to the ditch. Access should beprov'ided for each ditch company to maintain their respectjve djtches.Prior to any new road crossings of a ditch a wrjtten approval by therespective ditch company must be received specifying the size of theculvert and other requirements.

Exemption from defin'ition of Subdivision
App'licant: Jim Mazuchi
A 63 Acre tract of land in the S E +, Sectjon 2 and N E t, Sectjon 11,
T65, R92W located approximately one mjle east of Silt at the jntersection
of U S Highway 6&24 and Davis point Road.
We the undersigned request the Garfjeld County Board of Commissioners
add the fol I ow'ing restrict'ions 'if thi s exempti on j s approved.
No building or structure including power or telephone poles be
constructed such that they w'ill be visjble on the sky'line of Davis
Point from either the east or west djrectjon lookjng towards
Dav'i s Poi nt.
Restrjctjons on all lots be placed on the final plat to the effect
that of the three irrigation ditches that cross the 63 acres a
minimum of ?0 feet between the edge of any ditch and any structure
or fence be left open for access to the dr'tch. Access should be
provided for each ditch company to maintain their respective d'itches.
Prior to any new road crossings of a ditch a written approval by the
respective ditch company must be received specifying the size of the
culvert and other requirements.
