(1973) Section 30-28-l0l (10) (a) - (d) as amended, and the Subdivision Regulations of Gar[ield County, Colorado, adopted Ap.il 23,1984 Section 2:20.49, the undersigned 1I..,.^ N.rn ,tt\, i r"spectfully petitions the Board of County Commissioners of Garl-reld County, Colorado, to exempt by Resolution the division of b3 .acre [ract of land into 4 tracts of approximately - 5 - aO acres each, more or less, from the definitions of "subclivision" and "subdivided land" as the terms are used and dehned in C.R.S. Copy of the deed showing ownership by the applicant, or a letter from the property owner(s) if other than the applicant; and Names and addregses of owners of record o!!ining and within 200 feet of the proposed exemption,mineral owners of record of the property to be exempted, an<ftenants of any structure proposed for conversion; and Evidence of the soil types and characteristics of each type; and Proof of legal and adequate so)re\of domestic water for each lot created, method of sewage disposal, an(leffa:Jof approval of fire protection plan from appropriate fire district; and \-7 If connection to a community of municipal water or sewer system is proposed, a letLer from the governing body stating a willingness to serve; and Narrative explaining why exemption is being requesl.ed; and It shall be demonstrated that the parcel existed as described pn January 1,1973 or the parcel as it exists presently is one of not more than three parcels created from a larger parcel as it existed on January 1,1973. Mailing Address 5r \+CO City State 7.7t^- ta\s Telephone Number FYFMPTTC\N APPLICABILITY The Board of County Commissioners has the discretionary power to exempt a division of land from the dehnition of subdivision and thereby liom the procedure in these Regulations, provided the Board determines that such exemption will not impair or defeat the stated purpose of the Subdivision Regulations nor be detrimental to the general public welfare. The Board shall make exemption decisions in accordance with the requirements of these regulations. Following a review of the individual facts of each application in light of the requirements of these Regulations, the Board may approve, conditionally approve or deny an exemption. An application for exemption must satisfy, at a minimum, all of the review criteria listed below. Compliance with the review criteria, however, does not ensrue exemption. The Board also may consider additional factors lisl.ed in Section 8:60 of the Subdivision Regulations. A.No more than a total of fouf (4) lots, parcels, interests or dwelling units will be created from any parcel, as that parcel was described in the records of the Garheld County Clerk and Recor<ler's OIfice on January l, 1973, and is not a part of a recorded subdivision; however, any parcel to be divided by exemption that is split by a public right-of-way (State or Federal highway, County road or railroad) or natural feature, preventing joint use of the proposed tracts, and the division occurs along the public right-of-way or natural feature, such parcels thereby created may, at the discretion of the Board, not beconsidered to have been created by exemption with regard to the four (4) lot, parcel, interest or dwelling unit limilalien otherwise applicable; All Garfield County zoning requirements will be met; and All lots created will have legal access to a public right-of-way and any necessary access easements have been obtained or are in the process o[being obtained; and Provision has been madefor an adequate source of water in terms of both the legal and physical quality, quantity and dependability, and a suitable type of sewage disposal to serye each proposed lot; and All state and local environmental health and safety requirements have been met or are in the process of being met; and Provision has been made for any requirecl road or storm drainage improvements; and Fire protection has been approved by the appropriate fire district; and Any necessary drainage, irrigation or utility easements have been obtained or are in the process of being obtained; and B. A request for exemption shall be submitted to the Board on forms provided by the Garheld County Department of Development/Planning Division. Two (2) copies of the application maps and supplemental inlormation shall be submitted. B.ThePlanning Divisionshall reviewtheexemption requestforcompleteness withineight (8) days of submittal. If incomplete, the application shall be withdrawn from consideration and the applicant notified of the additional information needed. If the application is complete, the applicant shall be notified in writing of the time and place of the Board of County Commissioners meeting at which the request shall be considered. In either case, notification shall occur within lilteen (1 5) days of submittal. Notice of the public meel.ing shall be mailed by certified mail, return receipt requested, to owners of record of land immediately adjoining and within 200 feet of the proposed exemption, to mineral owners and lessees of mineral owners of record of the land proposed for exemption, and to tenants of any structure proposed for conversion. the exemption site shall be posted clearly and conspicuously visible from a public right-of- way with notice signs provided by the Planning Division. All notices shall be mailed at least fifteen (15) and not moTe than thirty (30 days prior to the meeting. The applicant shall be responsible for mailing the notices and shall present proof of mailing at the meeLing. At or within fifteen (15) days of the meeting, the Board shall approve, conditionally approve or deny the exemption request. The reasons for denial or any conditions of approval shall be set forth in the minutes of the meeting or in a written resolution. An applicant denied exemption shall follow the subdivision procedure in these regulations. C. D. This soil formed in mixed alluvium derived primarily from basalt. The surface layer is stony loam about 8 inches thick. The underlying material is very strongly calcareous very stony loam to a depth of 60 lnches. Permeability is moderately rapid, and available water capacity is low. Water Division 5, Water District 39 Dear Mark: We have review the above referenced subdivision exemption to be located east of the Town of Silt. The applicant proposes to split a 63+ acre parcel into four parcels of 43, 10, 5, and 5 acres each. An existing well permit, no. 183128, is proposed to be used to serve three of the parcels. A new well, augmented with a water allotment contract from the West Divide Water Conservancy District (District), is proposed to serve the fourth parcel. Permit no. 1 83128 was issued on Novemb et 4,1994, and is currently valid until November 4, 1996. The use of this well is limited to the ordinary household purposes inside three single family dwellings, the irrigation of not more than one acre of home lawns and gardens, and the watering of domestic animals. This permit will remain valid if the well is constructed prior to the expiration date and as long as the well is operated pursuant to the permit's conditions of approval. A permit for a second well to serve the fourth parcel would be available (in accordance with the requirements of Section 37-90-137(2), C.R.S.) upon application to this otfice and upon submission of a executed water allotment contract with the District. The operation of the well would be subiect to the terms of the District's Substitute Water Supply Plan. Diversions from the well could not exceed the acre-foot amount of the applicant's water allotment contract. lt would be helpful if the applicant identified which parcels are to be served by permit no. 1831 28, and which parcel is to be served by the proposed new well. No written comment has been recieved, but the Town Administrator has verbally indicated that he would be at the meeting on Monday. At the last meeting, it was recommended that the following conditions be added to those already in the staff report: Approval from the Bureau of Reclamation for the new crossing of the Farmers Irragation Ditch. Agreements from the other ditch companies for all of the other new crossings. In response to the concerns about the grade of the road and the need for building envelopes with slopes less than 40o/o, the enclosed information was submitted. (Se pgs.il-h\ Staff is concerned about the fact that the new documents show a different configuration of the property than the original submittal. There is an area excluded from the new maps that was previously shown as being aputof the property to be exe,mpted. If this property is to be excluded from the application, some documentation needs to be presented to the County Attorney for review and it will also be necessary to determine whether ornot the appropriate legal description was used for the notice sent to property owners within 200 ft. and mineral rights owners. If this property is excluded, it will also be necessary to create an access easement for the perpetual use of any property owner of an exempted parcel. The road grade map shows grades in excess of l4%o, which is the maximum allowed by the County Subdivision regulations. This will need to be corrected prior to the approval of any plat. In summary, there is no response to the previously noted issues regarding the diches, theremay be a need to readvertise the meeting due to a change in boundaries of the application and the road grades need to be addressed.
