when the following proceedings, among others were had and done, to-wit:

A RESOLUT]ON CONCERNED WITH GRANTING AN EXEMPTION FROI4 THE GARFIELD COUNTY
SUBDIVISION REGULATIONS FOR NOR}'IAN }'IEAD
WHEREAS, Norman Mead has petitioned the Board of County Commissioners
of Garfield County, Colorado, ior an exemption from the definition of the
terms nsubdivisio-n; and "subdivided 1and" unoer C.R.S. 1973, 30-28-101
(10) (a)-(d), as amended, and the Subdivision Regulations of Garfield
County, Colorado, adopteo ApriI 23, 1984, Section 8:00 through 8:60 and
for tle division of a 145 acie tract as described in Book 304, Page 350,
as filed in the Office of the Cl-erk and Recorder of Garfield County,
colorado into two tracts of approximately 5.31 acres and 140 acres each,
more or l-ess, which proposed aiviaea tracts are more practically described
as follows:
TRACT A: See attached 1egal description; Lot 1
TRACT B: That properly described in Book 304' Page 350,
Document #199152, less Tract A described above'
(in the State of Colorado and the County of Garfield); and
WHEREAS, the petitioners have demonstrated to the sat.isfaction of the
Board of county Commissioners of Garfield County, Colorado, that the
piopo""A division does not falI within the purposes of Part l, Article 28,
iiti" 30, Colorado Revised Statutes 1973, ds amended, for the reason that
the division does not warrant further subdivision review, and
WHEREAS, the petitioners have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that there is
a reasonabl-e piobability of l-ocating domestic water on each of said
parcels, that there is existing ingress and egress to saic parcels, that
in" Iocation of septic tanks will be permitted by the Colorado Department
of HeaIth, that the requested division is not part of an existing or
larger development uno does not fa11 within the general purposes and
intent of tha subdivision regulations of the state of colorado and Ehe
county of Garfield, and should, ttierefore, be exempted from the definition
of the terms nsubdivisionn and "subdiviOed landn as set forth in C.R.S.
I973, 30-28-101 (10) (a)-(d), as amended;

NOW THEREFORE, BE IT RESOLVED that the division of the above described
tracts 'An and nB', from the above described 145 acre tract is hereby
exempted from such definitions and said tract may be divided into said
tracls 'A' and 'B' and may be conveyed in the form of such tracts nA' andoB,, all as is more fu11y described above. Provided however, that this
exemption is granted on the condition and with the expressed understanding
and agreement of the Petitioner that no further exemptions be allowed on
said iracts except for family members of Ehe immediate family, and that a
copy of the instrument or instruments of conveyance wl:en recorded sha11 be
filed with this Resolution.
