DESCRIPTION OF PROPOSAL: A.Site Desgrlption: The site sits on a bench above the Colorado Rfver, wfEfr [nTmproved areas of pinon,/juniper and sage, along with a fairly large area of producbive cropland. The area slopes from the south to the northwest fairly gently, with some slopes of over 10t. Prcject Descriptigg: The proposal is to divide a 145 acre parcel inEo 2 patcels of 140 acres and 5 acres. Hislory: In L978, Norman Mead was granted a five acre exemption and'-fn-fggf he received two additional five acre exemptions. The original parcel was 160 acres. The remaining parcel is 145 acres. In 1983, the Assessorrs office discovered a 5 acre illegal lot sp}it. I"1r . Mead was contacted and is nov, requesting a S.B.35 Exemption to clear up the illega} split. The current situation is that Mr. Mead has i]legal}y split off a 5 acre parcel for his daughter-in-Iaw who has already built a home on the parcel. The home is currently served by a pipeline leading from Mr. Mead's wel1. The applicant, however, has applied with the Division of Water Resources for an additional individual well Permit. The proposal meets the density requirements of the Garfield County Zoning Regulations and the suggested density in the Garfield County Comprehensive PIan. rv.FINDINGS APPROVAL of The conditions: 1.That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that alI interested parties were heard at that hearing. That the proposed land use will be compatible with existing and permitted land uses in all directions. The plat shall be reviewed by the Department of Development and signed by the County Surveyor and the Board of County Commissioners. The plat shall include all necessary water line, well1 access and ditch easements for each of the 5 acre parcels. The plat shall read the 'l,lead Exemption' and make referenceto the Resolutions of Approval numbers which have approved the exemptions. c. D. E. -4/- Z. prior to final approval, the applicant shall submit $200.00 to the Garfield County Department of Development for the School Impact Fee. 3. prior to final approval, the applicant must receive approval from the Division of Water Resources for either use of his existing domestic well found on the 140 acre parcel or approval of an individual weII permit for the 5 acre parcel. 4. Any other lots requested to be divided off of the remaining 140 acre parcel must go through the full subdivision review process. No further exemptions shalI be allowed.
