D.e.p.ut.;y. .............. , Clerk of the Board when the following proce.1dings, among others were had and done, to-wit: RESOLUTION NO. 82-25 A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR Norman Mead. WHEREAS, Norman Mead has petitioned the Board of County Connnissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" tJnder C.R.S. 1973, ,30-28--101 (10) (a)-(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 150,acre tract described.as folJ.:ows: that parcel of land as described in Document No. 199152 as filed in the Office of the Clerk and Recorder of Garfield County; Colorado into 2 tracts of approximately 5 and 145 acres each, more or less, which proposed divided tracts are more particularly described as follows: TRACT A: A parcel of land contain .=d within the SE!i; of the SE!-4 of Section 23, - T6S, R94W of the 6th PrinciJ_:>al Meridian, more particularly described -- as follows: Beginning at the intersection of the southerly county road·R.O.W. with the west line of said SE!t; of SE!i; whence the stone marking the SE corner of_ said Section 23 vears S.00°14'25"E 746.61 feet and N.89°40'22"E 1331.62 feet, thence along the west line_ of said SE\ of the SE!i; S.00°14'25"E 498.61 feet to the approximate center line of Beaver Creek, thence along the approximate center line _of Beaver Creek N.89°07'38"E; 259.18 feet and S.83°13'17"E. 195.29 feet and S.73°11'44"E. 43.76 feet, thence N.00°14'25"W. 405.29 feet to the southerly R._O.W. line of the county R.O.W., thence along 'said R:o.w. N.75°49'48"W. 510.90 feet to the point of beginning. Containing 5.00 acres, more_or less. TRACT B: The re~aining 145 acres. (in the State_ of Colorado and County of Garfield)·; and WHEREAS; the Petitioner has demonstrated to the satisfaction of the Board of County Connuissioners of Garfield County, Colorado, that_ the proposed division does not fail within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created does not warrant further subdivision review, and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said -tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the d~finition oE the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended; ,. uoo~ 591 P~GE642 · NOW, TIIEREFORE, BE IT RESOLVED that the divisio.n of the. above describe..ci. tracts "A" and ''B''.,from the above described 150 acre tract ;;ts hereby ~.2xempted .. :from: ~uch definitions and said tract may be divided into tracts "A" and "B", all~as isfmore fully described above, and said divided tract may be conveyed in the f~~mof(such smaller tracts without further compliance with the aforesaid subdivisiorl. statutes and regulations; provided, however, that this ·exemption is granted on the cobdition and with the express understanding and agreement of the Petitioner that no further ex2mptions be allowed en said tracts "A" and only one further exemption be allowed on tract "B", and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution.
