' IIHEREAS, NoRMAN H. MEAD, has petitioned the Board of County Conmissioners of
Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-
lgl (10) (a) -(d) as anended, and the Subdivision Regulations of Garfield County'
Colorado, adopted Septenber 1,1972 and anended Apri'l 14, I975, Sections 1.02.17
(d) and 3.02.01, for the division of a 160 acre tract of land into two tracts of
5 and I55 acres, rpre or'less, and said 160 acre tract is more particularly
described as follows:
ESEl. of Section 23; SI^IkSW% of Section 24; Nl,lA{Hrz of Section 25,
Tovrnship 6 South, Range 94 l,lest of the Sixth Principal Meridian,
Excepting from said Section 23 a tract described as Beginning at
a point on the East Iine of said Section, whence the Southeast
corner of said Section bears South a distance of 33.l.7 feet, thence
llest 46.| feet, thence North 472.5 feet, thence East 46.] feet to
a point on the East line of said Section 23, thence South 472.5

UIHEREAS, the Petitioner has dernonstrated to the satisfaction of the Board of
County Conmissioners of Garfield County, CoIorado, that he desires said exemption
for the purpose of re-sale of said five acre trait into single-family
residentia'l acreage; .and,
|]}IEREAS, the Petitioner has denpnstrated to the satisfaction of the Board that
there is a reasonable probabitity of locating donestic water on each of said
tracts, that there is adequate ingress and egress to said tracts, that the location
of septic tanks will be permitted by the Colorado Department of Health, that the
requested division is in accordance with the general purposes and intent of the
Subdivision Regulations of the State of Co1orado and the County of Garfield and
should, therefore, b€ exempted from the definition of the terns i'subdivision"
and "subdivided land" as set forth in C.R.S. ('1973) Section 30-28-10I (10) (a) -
(d) as anended;
N0tl THEREFoRE, upon motion of AbtrU., J.Lerioe seconded by
? 0--JOileta and carried, said160 acre tract of land is hereby

exempted from such definition and transfer of said tract may be made by division
into two tracts of I55 and 5 acres, rpre or'tess, and further that said exemption
is conditioned upon obtaining a proper lega'l description for the five acre parcel
prior to conveyance and said five acre parcel shall not be eligible for any
further subdivision exemptions. A copy of the instrunent(s) of conveyance when
recorded shall be filed with this Resolution.
