MEfSNER and LOIS f. ^mfSNUn have petitioned the Board of Countlr Commissioners of Garfield County, Colorado, for an exemption under C.R. S. (1973) Section 30-28-101 (I0) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, L972 and amended April L4, L975, Sections 1.02.17(d) and 3.02.01, for the division of 30.68g acre tract into 2 tracts of approximately 20.905 acres and 9.'183 acres, more or less, and more particularly described as foLlovrs: EXHIBTT 'A'ATTACHED WHEREAS, the Petitioners have shown to the satisfaetion of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re-sale into single-family residential acredg€r and V{HEREAS, Petitioner has demonstrated to the satisfaction of the Board that there is a reasonable probability" of locating do- mestic water on each of said 20.905 and 9.783 acre tracts, that there is adeguate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado De- partment of Hea1th, that the requested division is in aceordanee with the general purposes and intent of the subdivision regul-ations of the State of Colorado and the County of Garfield and that said divLsion will actually restrict the density of housing within said area and should therefore be exempted from the definition of the terms "subdivision" and "subdivided land' as set forth in C.R.S.
