Minor (2 Lot) Exemption Application

Exemption Lot: 10.5 acre parcel to be created out of 196 acre Parent Parcel

Narrative
1. Adequate Water Supply - Section 7-104 of Article VII Land Use Code - Sufficient
Legal and Physical Source of Water.
There is no water well on the Parent Parcel nor is there a well on the Exemption
Lot. The Exemption Lot is -10.5 acres and is a compressor site and electrical
power supply site. The area is located near the Colorado River and is considered
to be a tributary area given the proximity of the river. Any well drilled would
require approximately two years to permit and an augmentation plan involving
considerable time and expense. There is no use of the Exemption Lot that
requires a water supply. There are no offices on site nor are any contemplated
nor is there space on the Exemption Lot to build an office structure or dwelling.
2. Adequate Water Distribution and Wastewater Disposal System - Section 7-105 of
Article VII Land Use Code - Adequate Water Supply.
There is no proposed use of the Exemption Lot that would require the use of a
distribution and disposal system for water. This is an industrial type of site and
there is no time in the foreseeable future that the site would be occupied by
persons in such a way that this system would be required. There is no water on
the site at present. There is no space on the Exemption Lot for a type of office
structure or dwelling.
3. Adequate Access - Section 7-108 of Article VII Land Use Code - Access and
Roadways.
There is adequate access to the site as is shown on the plats and the assessor's
map. County Road 300 is within 1300' of the site and Encana has entered into a
Road Right -of -Way Agreement with the Owners recorded at Reception #758031
in the records of Garfield County, copy attached, to use the existing private road
to access the Exemption Lot. This is a well maintained and well used road.
4. Hazards — Sections 7-209 and 7-210 of Article VII Land Use Code — Areas Subject to
Wildfire Hazards and Areas Subject to Natural Hazards and Geologic Hazards.
There are no hazards created by the Exemption Lot. This is a flat area with no
slopes. There is no proposed land use change and there are no trees or vegetation on site
that need to be cleared. None of the hazards cited in Section 7-210 apply to the
Exemption Lot.
5. Compliance with the Comprehensive Plan and Intergovernmental Agreements.
So far as has been determined in consultation with Garfield County Planning, the
Exemption Lot is in compliance.
6. Taxes
All taxes have been paid and are up to date.
7. Use of Exemption Lot — the site was approved for a total of ten (10) compressors and
there are currently four (4) located on the Lot. Two (2) are 2516 Caterpillar natural gas
driven engine compressors and two (2) are 7500 horsepower electric driven compressors.
Another 7500 Horsepower electric driven compressor will be added, utilizing the Xcel
capacitor station electricity supply. This will result in a total of three (3) electric and two
(2) gas compressors on the Exemption Lot. No other electric compressors can be placed
on location due to electricity supply constraints and the cost of connecting to an
additional supply line with is approximately $30MM.
8. Xcel/PSCo is filing an eminent domain proceeding against a 1.3 acre parcel at the
north end of the Exemption Lot but has not yet filed said paperwork.
9. Owner and Encana and PSCo are all in agreement on the use of the property and the
subdivision of the Exemption Lot.
