SPECIAL WARRANTY DEED
THIS DEED, made this 25th day of January, 2001 between Wells Fargo Bank West, N.A., formerly known as
Norwest Bank Colorado, National Association, successor in interest to Heritage Trust Company, Trustee FBO
Grand Junction Orthopedic Associates Pension Plan — William R. Patterson, now known as Rocky Mountain
Orthopaedic Associates P.C. Pension Plan — Patterson, of the City and County of Denver, State of Colorado,
Grantor, and Rodney C. Power, Grantee, whose legal address is 2415 F Road, Suite B. Grand Junction, CO 81505.
WITNESSETH, that the Grantor, for and in consideration of the sum of Three Hundred Twenty Thousand and
No/100 Dollars ($320,000.00), the receipt and sufficiency of which is hereby acknowledged, has granted,
bargained, sold and conveyed and by these presents does grant, bargain, sell, convey and confirm unto the Grantee,
his heirs and assigns, forever, all the real property, together with improvements, if any, situate, lying, and being in
the County of Garfield and State of Colorado, described as follows (the "Property"):

Also known by street and number as: Vacant Land
with all appurtenances and subject to real property taxes and assessments for the year of closing and
subsequent years; distribution utility easements (including cable tv); building and zoning regulations; matters
that would be disclosed by an accurate survey of the Property; covenants, conditions, restrictions, leases,
easements, rights-of-way, whether recorded or not; other matters of record. if any; and rights and claims of
co -tenants in the land and to the rights of anyone claiming under them, including but not limited to rights of
partition, claims for improvements, claims for reimbursement, creditor's claims and agreements between co-
tenants.
TOGETHER with all and singular the hereditaments and appurtenances thereunto belonging, or in anywise
appertaining, the reversion and reversions, remainder and remainders, rents, issues and profits thereof, and all the
estate, right, title, interest, claim and demand whatsoever of the Grantor, either in law or equity, in and to the
above bargained premises, with the hereditaments and appurtenances;
TO HAVE AND TO HOLD the said premises above bargained and described, with the appurtenances, unto the
Grantee, his heirs and assigns forever. The Grantor, for itself, its successors and assigns does covenant and agree
that it shall and will WARRANT AND FOREVER DEFEND the above -bargained premises in the quiet and
peaceable possession of' the Grantee, his heirs and assigns, against all and every person or persons claiming the
whole or any part thereof, by, through or under the Grantor.
Wells Fargo Bank West, N,A., has executed this deed not personally but solely as Trustee of the Rocky Mountain
Orthopaedic Associates Pension Plan - Patterson. Therefore, Grantee waives any claim or right to proceed for the
enforcement of any of his rights hereunder against Wells Fargo Bank West, N.A., in its individual capacity.
This Special Warranty Deed is given in connection with a Trust Affidavit recorded contemporaneously herewith.
