COIINIY SUBDIVISION REGIJLATIONS FOR KENNETH MELBY
l[Im.EAS, Kenneth Melby has petitioned the Board of County Couunissionersof Garfield County, Colorado, for an exemption frorn the definition of the-terms
'rsubdivision" and "subdivided 1and" under c.R.s. 1g73, 3o-2g-lo1 (Lo) (a)-(d),as amended, and the Subdivision Regulations of Garfield Cor.nty, Colorado,adopted January 2, L979, secEions z.oz.zr (d) and 3.02.01 for the use of thetract described as follows:
A tract of land situated in the NwtsEZ, and NELshIt, Section 2,
Township 6 south, Range 89 l.Iest of the 6th. p.M. and rnore fu1lydescribed as follows:
Beginning at a point on the North liae of sald }{l#asEl at thei.ntersection with the westerly line of a deeded 1and, whencethe Northwest corner of said MITSEL bears N. gg"Z7t W. IIHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Conmi.ssj.oners of Garfield County, Colorado, that the pro-
posed division does not faIl within the purposes of part L, Article 2g,Titl-e 30, Colorado Revised Statutes 1973, as amended, for the reason thatthe parce1 is adequately served by existlng streets, water, and sewer, and.the inpact created does not warrant a fu1l subdivision review; and
WIIEREAS, the Petitioner has demonstrated to the satisfaction of theBoard of County Coumissioners of Garfield County, Colorado, that there isa reasonable probability of locating domestic water on each of said tracts,that there is adequate ingress and egress to said tracts, that the locationof septic tanks will be perritted by the Colorado Department of Health, thatthe requested division is not part of an existing or larger development and
does not fall within the general purposes and intent of the subdivision
regulaEions of the State of Colorado and the County of Garfie1d, and shouLd,therefore, be exempted fronn the definition of the terms ttsubdivision" and,rrsubdivlded land" as set forth in c.R.s. L973,30-28-101 (10) (a)-(d), as
amended;
