A quick status summary is noted below: • I followed up with your surveyors on a couple of minor plat certificate and plat note issues. There are a couple of additional plat notes from the Director's Decision Letter Exhibit "A" that will be added. He will also be adding a Title Certificate, County Clerk and County Surveyor Certificates. We discussed whether there were any lien holders and if there are we'll need a certificate for them. That was something that Brett was going to check with you on. Thanks for talking to them. Britt did not check with me on that, but I'm almost certain there are no lien holders on the property. Lew Ron can respond to confirm though. • Condition #4 is addressed by inclusion of a plat note. Great. • The latest version of the Plat shows an increase in width at the north end of Lot B satisfying Condition #5. Great. • Condition #6 regarding weed control will be addressed at building permit and was addressed with a plat not.. Great. • We have correspondence from the Town of Carbondale, Tap Fee Transfer Code Language, and records of conversations with the Town that have satisfied Condition #7. Great. t • Carey has reviewed the Declaration of Easement for Condition #10. We will need a final version for our files. No problem, I will get it to you when it is recorded. • I believe you had resolved the Fire Protection District issue (Condition #11). I have contacted the Fire District to obtain documentation (i.e. email or correspondence) for our files. Did you receive anything yet or would you like me to contact them? • We have text for the plat note (Condition #12) regarding relocation of the cabin. Do you have a draft of a similar deed restriction to be recorded concurrently with the plat per Condition #12? I was planning on using the same language approved by Carey for the deed restriction. After recording of the plat, I planned on doing two deeds — one from Lew Ron and Jackie to Lew Ron and Jackie with that restriction and then one for the other parcel (no restriction). Will that work? • I believe that Condition #13 regarding irrigation rights was being worked out but we'll need some documentation for our files. I was planning on handling the conveyance of pro rata water rights with the recording of the two deeds above. Will that work? • In regards to Condition #14 we'll double check the Plat notes and irrigation easements with your surveyor. We will need a copy of the Utility Extension Agreement and recording information that we can add to the plat note. My take is we are down to a documentation items and final review of the plat (prior to producing the mylar). Thank you for all your work on finalizing the approval. I.) A Garfield County Surveyor Certificate is needed on the plat. Once this comment has been addressed and all final comments from Community Development have been completed, the Mylar may be prepared for recording. The Mylar shall be delivered to the Community Development office with all private party signatures no later than Monday the week prior to the next commissioner meeting day in order to make that meeting. The information cited Town of Carbondale code sections addressing the topic. In order to confirm our understanding of the Town Code staff followed up with several phone conversations with Mark. These conversations were supportive of the Thompson's proposal to transfer their existing taps (associated with their cabin) along with their cabin when they relocate it to an adjacent lot within the Thompson Minor Subdivision Exemption. A final conversation was held with Mark on May 16, 2013 at which time Mark confirmed that the Thompson's proposal to transfer taps associated with the existing Cabin (on Lot 1 of the TLCCO Inc. Subdivision Exemption) to the Cabin's new location on Lot A of the Thompson Exemption does fit the criteria for a Tap Transfer contained in the code sections he had previously provided. I indicated that the County would proceed with finalizing and recording the plat based on that representation and we both understood that no additional written verification would be necessary. Are you referring to the water taps? Below is the Municipal Code verbiage on tap transfers: 13.24.040 - Transfer of taps. - - A. If an owner has a bona fide water or wastewater tap on a town main not adjacent to the property served, and the tap is not used or required to be used, the town may authorize relocation of the tap or taps to the main adjacent to the property served. Payment of the cost of materials and labor for the relocated tap and satisfactory arrangements for abandonment of the old tap at the main shall be made when the tap relocation is approved. No additional tap fee shall be charged for relocated taps that are of the same EQR rating as the original tap. Proof of ownership of a bona fide tap shall be the responsibility of the applicant for a tap relocation. Any increase in EQR's of the tap that is relocated shall be paid for at the time the tap relocation is approved by the town. No refund shall be paid if there is a decrease in EQR's. If the town initiates a main installation for replacement of a town main, the town shall bear the cost of transferring taps and "trying over" the customer's service line. B. If there is more than one customer served by a tap to be transferred, no credit shall be allowed to any of the customers. C. No credit is allowed when a tap is transferred from a private service line or main to a town main. D. A customer relocating a tap to avoid future problems with freezing will receive a transfer tap upon payment of the materials and labor from the town. E. The applicant for a tap transfer shall pay the cost of excavation, materials, and all labor including labor provided by the town for making the new tap and inspecting the installation. The transfer of existing taps for the Cabin Relocation was the only other question. The existing taps for the Thompson's Cabin are proposed to move with the cabin to its new location on Lot A of the Thompson Exemption. I believe that there is a provision in their tap agreement or the Town regulations that would allow this shift. My understanding is that the existing location for the cabin currently served by the taps was outside of the Town at the time the taps were originally granted. An email or letter confirming that the transfer — shift of the existing taps is acceptable would be most appreciated. Please call if you have any questions. Thanks again for your assistance. This has been historically served by an ISDS (septic system). The Town has been approached to allow for a special consideration for tapping onto the wastewater treatment system which has been denied due to a moratorium for out of Town taps. In consideration of this. the Town of Carbondale accepts the future use of the 1SDS for this property. If you have any questions regarding this matter, please contact Mark O'Meara at 970-963- 3140.
