SPECIAL WARRANTY DEED
THIS DEED, made on this ;,;,/1, day of

LEWIS R. THOMPSON and JACQUELYN TI-IOMPSON, Grantor, and
LEWIS R. THOMPSON and JACQUELYN THOMPSON
whose legal address is 1605 Highway 133, Carbondale, CO 81623
of the County of Garfield and State of Colorado, Grantees
WITNESS, that the Grantor, for and in consideration of the sum of Ten Dollars,
the receipt and sufficiency of which is hereby acknowledged, has granted, bargained, sold
and conveyed, and by these presents does grant, bargain, sell, convey and confirm unto
the Grantees, their heirs and assigns forever, in joint tenancy, all of the real property,
together with improvements, if any, situate, lying and being in the County of Garfield and
the State of Colorado, described as follows:
Lot A of the Box T Subdivision Exemption recorded '3.12)-2030.1 8c/06/45
Lot A shall be restricted in use to only the relocation of the existing cabin from
Lot 1 of the TLCCO Inc. Subdivision Exemption. Lot A may be released from
this restriction upon submission and approval of an amended Subdivision
Exemption Application
Such conveyance shall include any all decreed and un -decreed water, ditch,
reservoir, well, spring, seepage and pond rights, and any and all other types of rights to
the ownership of water, tributary or non -tributary, underlying, appurtenant to, or
customarily or historically used upon or associated with the real property including, but
without limitation, 0.077178 cfs, absolute, water right decreed for diversion from the
Crystal River in the Carbondale Ditch under Priority No. 169, with an appropriation date
of April 1, 1887 by entry of a decree by the Garfield County District Court on May 11,
1889 in Civil Action No. 132, and 0.04302075 cfs, absolute, water right decreed for
diversion from the Crystal River in the Carbondale Ditch under Priority No. 408 with an
appropriation date of April 1, 1920 by entry of a decree by the Garfield County District
Court on August 25, 1936 in Civil Action No. 3082, together with the right to claim any
and all historical consumptive use associated with said 0.077178 cfs and 0.04302075
absolute water rights in the Carbondale Ditch.
TOGETHER with all and singular and hereditaments and appurtenances thereto
belonging, or in anywise appertaining and the reversion and reversions, remainder and
remainders, rents, issues and profits thereof; and all the estate, right, title, interest, claim
and demand whatsoever of the Grantor, either in law or equity, of, in and to the above
bargained premises, with the hereditaments and appurtenances;

TO HAVE AND TO HOLD the said premises above bargained and described
with appurtenances, unto the Grantees, their heirs, successors and assigns forever. The
Grantor, for itself, its successors and assigns, does covenant, and agree that it shall and
will WARRANT AND FOREVER DEFEND the above -bargained premises in the quiet
and peaceable possession of the Grantees, their heirs, successors and assigns, against all
and every person or persons claiming the whole or any part thereof, by, through or under
the Grantor.
