WHEREAS, DAVID A. MILLER, has petit.ioned the Board of County Commissioners
of Garfield County, Colorado for an exemption under C.R.S. (1973) Section 30-28-
·101 {10) (a) -(d) as a1TJended; an'd the Subdivision Regulations of Garfield County,·
Colorado, adopted September 1; 1972 and amended April 14, 1975, Sections 1.02.17
(d). and 3.02.01, for the purpose of relocating a common boundary by a total of
15 feet between Lots 6 and 7 of Block l of the Midland Grade Subdivision, and
more particular1y described as follows:
Lot 6, Block 1, . 285 acres, Mi d1 and Grade Subdivision
Lot 7, Block 1, .216 acres, Midland Grade Subdivision
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield ·county, Colorado that said exemption will
m:;t cause any third-party ownership, that the requested relocation is in accordance
with the gene:ral purposes and intent of the Subdivision Regulations of the State
of Colorado and the County of Garfield and should, therefore, be exempted from
the definition of the terms 11 subdivision 11 and 11 subdivided land" as set forth in
C.R.S. {1973) Section 30-28-101 (10) (a) -(d) as amended;
NOW THEREFORE, ,upon motion of Levn; U&lfJ5qr)c2-.·. seconded by
f:fc>ve,,;h f!.evt'.:se-, and carried, said relocation of a common
property boundary between Lots 6 and 7 of the Midland Grade Subdivision is hereby
exempted from such definition. A copy of the instrument(s) of conveyance when
recorded sha 11 be fi 1 ed with this Reso 1 uti on.
