I Clerk of the Board when the following proceedings, among others were had and done, to·wit: RESOLUTION NO. 8l-l 9 0 RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR W. C. MEADOWS. WHEREAS, W. C. Meadows has petitioned the Board of County Connnissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdiv- ision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 7.09 acre tract described as follows: A parcel of land situated in Lot 6 of Section 9, Township 6 South, Range 92 West of the Sixth Principal Meridian, Garfield County, Colorado, lying South- asterly of the Southerly right-of-way line of Interstate 70, said parcel of land is more fully described as follows: Beginning at the intersection point of said right-of-way line and the East line of said Lot 6; whence the Northeast Corner of said Section 9 bears: N. 43°40'57" E. 1884.39 feet; thence S. 00°43'35" E. along said lot line, 809.28 feet to a point on the North bank Meander Line, being the Southeast Corner of said Lot 6; thence N. 59°15'00" W. 609.76 feet along said Meander Line; thence N. 50°30'00" W. along said Meander Line, 235.34 feet to a point on said right-of-way line; thence, along said right-of-way line, N. 57°58'30" E. 307.92 feet; thence 472.45 feet along the arc of a curve to the right, having a radius of 2714.789 feet, the chord of which bears: N. 66°59'13" E. 471.86 feet, to the point of beginning, containing 7.09 acres, more or less, into 2 tracts of approximately 4.32 and 2.68 acres each, more or less, which proposed divided tract(s) are more partic- ularly described as follows: Tract A: A parcel of land situated in Lot 6 and the Meander Land of the Grand (Colorado) River being in the SW!z;NE!i;, all in Section 9, Township 6 South, Range 92 West of the Sixth Principal Meridian, Garfield County, Colorado, said parcel of land is more fully described as follows: Beginning at a point on the East line of said Lot 6, whence the Northeast' Corner of said Section 9 bears: N. 35°58'13" E. 2206.65 feet; thence S. 00°43'35" E. along said East line, 490.81 feet to the centerline of the Colorado River; thence N. 88°30'00;i w. 168.58 feet along said centerline of river; thence N. 11°43 1 30" w. 480.75 feet; thence N. 32°35 1 13" E. 126.08 feet; thence S. 64° 45'00" E. 212.38 feet to the point of beginning, containing 2.68 acres, more or less, and WHEREAS, the Petit:).oner has demonstrated to the satisfaction of t·he Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that this entails a readjustment of property lines, and no new parcels are created, and WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of loc- ating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the ·~ . BOOK 574 P~GE 563 State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973 30-28-101 (10) (a)-(d), as amended; NOW, THEREFORE, BE IT RESOLVED that the division of the above described tracts "A", from the above described 7.09 acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A", all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without fur- ther compliance with the aforesaid subdivision statutes and regulations; provided, how- ever, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioner(s) that no new lots shall be created, that no further exemptions be allowed on said tract "A", and further, that the Garfield County Planning Department receive a copy of the signed deed showing conveyance of the 2.68 acre parcel to Clyde Sievers; that the Planning Department receive a letter from W. C. Meadows auth- orizing the application by Clyde Sievers; and further that no building permits may be issued for the 2.68 acre site.
