Exemption, 33 Acre Tract
Dear Gl en:
It is my understanding that any subdivision exemption
proposal must provide for a supply of domestic water
as a condition of the subdivision regulations. We are
attempting to subdivide our property into tracts of 55
acreso 3 acres (including our house) and 33 acres. We
have well permits for the 55 acre tract and the 3 acre
tract and we are willing to covenant that no bui'lding
permit be issued and that no conveyance of the land of
any kind will be made unless further subdivided through
county procedure.
Further, we agree that if domestic water were needed that
we would provide it by fi1'ling a dornestic storage cisterh
from our water rights in the Moda and/or Lynch Ditch and
would deed to any subsequent owner the necessary water
to do same.

Dear Mark:
Enclosed please find the required items for an exemption
hearing for property on Four Mile Road owned by Tom and
Susan Meason. In support of the petitions, the Measons
present the followingl information:
L. The Measons wish to sell 55 acres of their 91
acre property, retaining 36 acres. This will
require refinancinq their existing mortgage and
their lender has requested their house and 3
acres as security. Hence, the request for parcels
of 55 acreso 3 dcres and 33 acres.
2. The Measons have no desire to separately sell the
3 acre and 33 acre tract and are wi]l ing
to consider them as one tract for any future
conveyance.
3. This property was previously divided into a tractof 91 acres and a tract of approximately 150 acres
by Mr. Louis l.{oda. l4r. Moda was the origina'l owner
and enclosed is a copy of his patent. Mr. Moda's
division of land was along the County road, hence,
a natural division.
4. All County Zonihg Regulations will be met.
5. All lots have 1ega1 access to Four Mile Road, a
County road.
6. Well permits have been obtained and are attached.

Septic tank will be used for sewage disposal and
are adequate and appropriate for tract of this size.
All state and local environmental issues will be
adequately addressed.
No provision is necessary for road and storm drainage.
No drainage, imigation or utility easements are nec-
essary.

The water table fluctuates between depths of 2 and 4 feet and in some

are not suitable because of the hazard of eroslon. Proper stoeklng rates,
pasture rotaElon, and restricted qrazLtg durlng wet perlods help to keep the
pasture In good conditlon and to protect the soll from eroslon. Fertlllzer
ls needed to insure optimum growth of grasses and legumes. If properly
managed, thls unit can Droduce 4 tons of lrrigated grass h.y per acre.
This unit is suited to lrrigated crops. It ls llmited mainly by slooe.
Corrugatlon irrigation is sulted to t.hls unit. If furrow or corrugation
lrrigation systems are used, runs should be on the contour or across the
slope. Because of the slow permeablllty of the subsoIl, the applicatlon of
water should be regulated so that water does not stand on t.he surface and

Crops respond to rrltrogen and phosphorus fertillzer. If properly managed,

Gentl emen:
Attached please find the receipts and return cards for
certified mailings regarding the above exemption request..
As you are aware, the Measons are requesting this exemption
soley for the purpose of obtaining a new loan on their house
and 3 acres. To this end they suggest that the resolution
granting the exemption contain the condition or covenant
that no building permit be issued and that no conveyance'
other than a mortgage or deed of trust, of any kind be
made of the 33 acre tract. Further, that the 33 acre tract
must always be conveyed with the 3 acre tract unless sub-
divided through your standard ordinances. If the resolution
were so worded and then recorded in the Garfield County
Records I believe the County would have full coverage of
any concerns.
