Garfield County Court House Glenwood Springs, Colorado 81601 RE: l4eason SB 35 Exemption, 33 Acre Tract Dear Gl en: It is my understanding that any subdivision exemption proposal must provide for a supply of domestic water as a condition of the subdivision regulations. We are attempting to subdivide our property into tracts of 55 acreso 3 acres (including our house) and 33 acres. We have well permits for the 55 acre tract and the 3 acre tract and we are willing to covenant that no bui'lding permit be issued and that no conveyance of the land of any kind will be made unless further subdivided through county procedure. Further, we agree that if domestic water were needed that we would provide it by fi1'ling a dornestic storage cisterh from our water rights in the Moda and/or Lynch Ditch and would deed to any subsequent owner the necessary water to do same. The maln concern ln productng and harvestlng timber ls slope. Conventional methods of harvest are dlfficult to use because of the steepness of slope. Thls unlt is poorly sulted to homeslte developmenE. The maln llmita- tlons are steepness of slope and slumolng when excavaElons or road cuEs are made. This rnap unlt ls ln capablllEy unlt VIIe. It ls ln Spruce-Flr woodland slte. LL/sz 42-Pluvaquente, 0 to l0 percent elopes. Thls broadly deflned unlE consists of deep, somewhat poorly dralned, nearly level soils on flood pralns and alluvlar valley floors. The solls formed ln alluvlum. Fluvaquents are straEifled and vary wldely ln texture and depth to sand, gravel and cobbles. The surface layer is loamy sand to fine sandy loam and sllty loam to clay loam. The underlylng layers are generally sandy loam or loam at.raElfted wlch sand, graver, and cobbles. rn some areas graver and cobbles are on or near the surface. The water table fluctuates between depths of 2 and 4 feet and in some areas ls near the surface durlng eorlng runoff fron snowmelt. These soils are sub-Ject to brlef, occaslonal flooding late in sprlng and earry in summer. Included ln mapping are small tsolated areas of Redrob soils. Sma1l, lsolated areas where water sEands aE or near Ehe surface all year are identlfied by wet spot and rnarsh spot symbols. These areas rnake up 15 percent of the map unlt. These so1ls are used for wirdlife habltat, recreatlon and grazlng. The natlve vegetation ls malnly eottonwood, willow, and water tolerant grasses, sedges and rushes. It ts also used for rangeland, llmited lrrigated cropland and homeslte development. The potentlal plant communlty on Ehis unlt ls malnly leEterman needlegrass, Idaho fescue, western wheatgrass, mountain biq sagebrush and Saskatoon servlceberry. Other less numerous plant,s thaE characEerlze Ehls site are slender wheaEgrass, lanceleaf rabbit.brush, elk sedge and scattered Gambel oak. The average annual productlon of air-dry vegeEatlon ls about 11500 pounds per acre. If the range condltlon deEerlorates, mountain blg sagebrush, lanceleaf rabblEbrush, Kentucky bluegrass and annual weeds I ncrease . L, If the range vegetaclon ts sertously deEeriorated, seedlng ls needed. The suitabillty of thls unlt for rangeland seedlng ls good. The Acree soll is well suited to hay and pasture. Seedbed preparation should be on the contour oi across the slope where practlcal. A11 adapted pasture plants can be grown, but bunch-type specles planted alone generally are not suitable because of the hazard of eroslon. Proper stoeklng rates, pasture rotaElon, and restricted qrazLtg durlng wet perlods help to keep the pasture In good conditlon and to protect the soll from eroslon. Fertlllzer ls needed to insure optimum growth of grasses and legumes. If properly managed, thls unit can Droduce 4 tons of lrrigated grass h.y per acre. This unit is suited to lrrigated crops. It ls llmited mainly by slooe. Corrugatlon irrigation is sulted to t.hls unit. If furrow or corrugation lrrigation systems are used, runs should be on the contour or across the slope. Because of the slow permeablllty of the subsoIl, the applicatlon of water should be regulated so that water does not stand on t.he surface and damage the crops. The organic matter conEent can be malntalned by ustng all croD residue, plowlng under cover croDs, and uslng a suiEable roEatlon. Crops respond to rrltrogen and phosphorus fertillzer. If properly managed, thls unlt can produce 60 bushels of barley per acre. Thls unlt ls poorly sulted Eo homeslte developmenf. The maln Ilmlraulons are shrlnk-swell poEenElal, Iow strengch, and slow perrneablllty. Population growth has resulted ln lncreased constructlon of homes on thls unlt. As you are aware, the Measons are requesting this exemption soley for the purpose of obtaining a new loan on their house and 3 acres. To this end they suggest that the resolution granting the exemption contain the condition or covenant that no building permit be issued and that no conveyance' other than a mortgage or deed of trust, of any kind be made of the 33 acre tract. Further, that the 33 acre tract must always be conveyed with the 3 acre tract unless sub- divided through your standard ordinances.
