The site consists of 91 acres. Individual well and cistern. Individual sewage disposal systems. Existing and proposed access off of County noad 117. A/R/RD A/R/RD I.RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District E, Rural Areas with Severe to Moderate Environmental Constraints as indicated on the Garfield County Comprehensive Plan Management Districts Map. II. DESCRIPTION OF THE PROPOSAL A.Site Description: The site includes approximately 5 acres of pasEure anE-Fs surrounding a single dwelling unit and numerous sheds and barns, all located between County Road 117 and Four Mile Creek. The remaining acreage is mainly unimproved with native type vegetation and moderate to steep slopes. Project Description: The applicants propose to divide the 9I acreTreEFTnEo-Eh-ree lots. Parcel I consists of 55 acres with proposed improvements, Parcel 2 is 33 acres with no improvements planned, while Parce1 3 is 3 acres in size with existing dwelling, well, and septic system. c.History: The existing 91 acre tract was created and conveyed to EE-e-Gesons out of an original 24L acre parcel in May of 1983. III.MAJOR ISSUES AND CONCERNS The applicants propose to hold Parcels 2 and 3 in common ownership with no dwelling units proposed on the larger parcel. They are in agreement with the addition of plat notes or building envelopes to the exemption plat Ehat would- restr ict development of the 33 acre parcel. (See ietter, page 4 ). Eor the purposes of complying wit,h SecEion 8.52 (d) of the Garfield County Subdivision Regulations which requires that an adequate and legal source of domest,ic waEer be established for each lot, the applicants propose individual wells for Parce1 1 and 3, ancl the use of a cistern in con junction wit.h existing irrigation rights on Parcel 2. B. 1. 2. -/- Soil Conservation Service information indicates severe limitations on homesite and individoal sewage disposal sysEems across most of the site. Soil problems identified included: shrink,/swel1, low strength soils, flooding and wetness, slowpermeability, slopes and slumping. Driveway access permit,s should be obEained from the Garfield County noad and Bridge Department. The Supplementary SeEback Regulations of the Garfield County zoning Resolution requires a 30 ft. greenbelt setback measured horizontally from and perpendicular to t.he high mark on each sideof any Iive stream. RECOMMENDATION APPR0VAL, pending the determination by the Board of County Commissioners that the proposed use of a cistern for domestic water on Parcel 2, constitutes a legal and adequate source of domestic water, and with the following conditions: V. 1. That the following plat notes be included' on exemption plat:the recorded A. Each lot may be subject to engineered foundations and septic systems. B. Each lot shall be required to submit a detailed soils studywith the buitding permit application to determine if engineered foundations and septic systems wiIl be required. C. The Colorado oivision of Water Resources has not issuedr or agreed to issuer dn additional well permit for Parcel 2. Approval of this subdivision exemption in no way impliesthat such a well permit may or may not be approved. The approvetl source of domestic water for Parcel 2 is a cistern. 2. Garfield County Court House Glenwood Springs, Colorado 81601 RE: l4eason SB 35 Exernption, 33 Acre Tract Dear Gl en: It is my understanding that any subdivision exemption proposal must provide for a suppty of domestic water as a condit'ion of the subdivision regulations. We are attempting to subdivide our property into tracts of 55 acres, 3 acres (including our house) and 33 acres. l^le have well permits for the 55 acre tract and the 3 acretract and we are willing to covenant that no buildingpermit be issued and that no conveyance of the land of any kind will be made unless further subdivided through county procedure. Further, we agree that if domestic water were needed that we would provide it by filling a domestic storage cistern from our water rights in the Moda and/or Lynch Ditch and would deed to any subsequent owner the necessary waterto do same.
