At a regular meeting of the Board of County Commissioners for
Garfield, Colorado, held at the Commissioners' Annex in Glenwood Springs
on Monday , the 4th day of April A.D. 19 83 , there were
present:

the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 83-92
A RESOLUTION CONCERNED WITH THE APPROVAL OF THE SKETCH PLAN FOR THE LAURA LEE
SUBDIVISION.
WHEREAS, Bill and Laura Smith have filed an application with the Board of
County Commissioners of Garfield County, Colorado, for approval of a sketch
plan for the Laura Lee Subdivision; and
WHEREAS, based upon the material submitted by the applicant, and the
comments of the Garfield County Department of Development, Planning Division,
and the Garfield County Planning Commission, this Board finds as follows:
1. That proper publication and public notice was provided as required by
law;
2. That the meetings before the Planning Commission and the Board of
County Commissioners were extensive and complete, that all pertinent facts,
matters and issues were submitted and that all intereted parties were heard at
those meetings;
3. That the proposed sketch plan is in general compliance with the
recommendations set forth in the master plan for the unincorporated area of the-
county;
hecounty;
4. That the sketch plan conforms to the requirements of the Garfield
County Subdivision Regulations;
5. That the sketch plan coforms to the requirements of the zone district
in which the development is located;
6. That for the above -stated and other reasons, the sketch plan qualifies
for approval by this Board.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Garfield County that the sketch plan for the Laura Lee Subdivision be approved
for the following described unincorporated area of Garfield County, with the
following stated conditions:
1. If the Division of Water Resources approves the shared use of these •
wells, the applicant must provide evidence of authorization from the landowners
outside the development that joint usage of the wells will be allowed. The -
applicant must also provide evidence of well maintenance easements from the
wells to each parcel served by those wells. Joint ownership and maintenance of
all pumping facilities, etc., must also be addressed.
2. The County Road Supervisor has indicated that the shared access points
onto County Roads 237 and 266, as presented in the sketch plan, will present no
problems. These stretches of road have a good line -of -sight in the vicinity of
the proposed access points; and the road surface is generally in good
condition. Culvert sizes, lengths, and construction will need to be addressed
in the Preliminary Plan drainage study.

LEGAL DESCRIPTION: A portion of the NE 1/4 SE 1/4 of Section 35, Township 5
South, Range 92 West of the 6th Principal Meridian, Garfield County, Colorado,
more particularly described as follows: Beginning at the East one-quarter
corner of said Section 35; thence S.0°25'45"E. 662.53 feet along the east line
of Section 35; thence N.89°33'51"W. 502.00 feet; thence S.0°25'45"E. 662.52
feet; thence N.89°33'51"W. 830.11 feet along the south line of the NE 1/4 SE
1/4 of Section 35; thence N.0°09'29"W. 1312.67 feet along the west line of the
NE 1/4 SE 1/4 of Section 35; thence N.89°54'15"E. 1325.77 feet along the
east/west centerline of Section 35 to the point of beginning. Containing
32.600 acres, more or less.
