when the following proceedings,
among others were had and done, to -wit:
RESOLUTION NO. 83-275
A_RESOLUTION CONCERNED WITH THE APPROVAL OF THE PRELIMINARY PLAN OF THE
LAURA `LEE SUBDIVISION.
WHEREAS., Bill and Laura Smith have filed an application with the
Board of County Commissioners of Garfield County, Colorado, for approval
of a Preliminary Plan for the Laura Lee Subdivision; and
WHEREAS, based on the material submitted ay the applicant and the
comments of the Garfield County Department of Development/Planning
Division, this Board finds as follows:
1. That proper publication and public notice was' provided as'
requited,by law for the hearing before the Planning Commission.
2. That the hearings' before the Planning Commission on June 8 and
July 13', 1983 were extensive and complete, that all pertinent
facts, .matters and issues were submitted and that all interested
parties were heard at that.hearing. •
3. Thatthe Garfield County Planning Commission recommended approval
o.f' the Preliminary Plan.
4." That the proposed.subdivision of land 'is in"compliance With the
recommendations set forth in the Comprehensive Plan for the
unincorporated area of the county.
5. That all data, -'surveys,' analyses, studies, plans and designs as
are required by the State of Colorado and Garfield. County have'
been submitted, reviewed, and found to meet all sound planning
and engineering requirements of the Garfield County Subdivision
Regulations
6. 'That •the proposed subdivision of land conforms to -the Garfield
County, Zoning Resolution
7. That for the above -stated and other reasons, the proposed
subdivisionis in the best interest of the.health,-safety,
morals, convenience, -order, prosperity, and welfare;of the
citizens of Garfield County,
NOW, THEREFORE, BE IT RESOLVED that the"PreliminaryPlan .of the Laura
Lee Subdivision on. the following described unincorporated area of:,Garfield
County, be approved with the following, conditions:
1. A'20` easement shall be noted on the Final Plat for the Lateral
Irrigation Ditch #34 for the maintenance needs -of the.ditch users.
2 A width of at least 16' for each access drive shall -be noted on
the,..final plat and the ends of the culverts shall be encased in
concrete being a length approved by the County Road -Supervisor or
extended -a minimum of -3` beyond the traveled width of the driveways.
The culverts shall be a minimum of 24" in diameter.
3. The following shall be done regarding the declaration and
agreement documents for joint ownership -and operation of the -wells for
the Laura Lee Subdivision:
That reference be made to the property deed book andpage
number on the declaration and agreement documents;
That when each. lot-is:sold,-the declaration and agreement
documents. must be incorporated into the -deed transferring
the well, r ights and easements with. the actual ` property deed
to the new owner.

• That a 5000 gallon cistern be centrally located in the
subdivision to provide adequate fire pr�tection to the
subdivision:
• That the lot line between Lot #1 and Lot #2 as shown on the
Preliminary Plan be eliminated to create one .,5acre lot rather
than two 2.5 acre lots.
• That $800.00 shall be paid to the Department of Development.t
cover the School Impact Fee required by the school district.,
LEGAL DESCRIPTION:
A.portion of the NE 1/4 SE 1/4 of.Section 35, Township 5 South, Range 92
West of the 6th Principal Meridian, Garfield County, Colorado, more
particularly described as follows: Beginning at the East one-quarter
corner of said Section 35; thence S.0°25'45"E. 662.53 feet along the east
line of Section 35; thence N.89°33`51"W. 502.00 feet; thenceS.0°25'45"E.
662.52feet; thence N.89°33'51"W. 830.11 feet along the south line of the
NE 1/4 SE 1/4 of Section 35; thence.N.0°09'29"W. 1312.67 feet along the
west line of the NE 1/4 SE .1/4 of Section 35; thence N.89°54_'15"E. 1325.77
feet along the east/west centerline of Section -35 tothe point of
beginning. Containing 32.600 acres; more or less.
