PROJECT INFORMATION AND STAFF COMMENTS
PROJECT NAME: Laura Lee Subdivision
APPLICANT: Bill and Laura Smith

LOCATION: Approximately 2 miles northwest of
Silt off County Road 237 and 266
SITE DATA: A 32.60 acre parcel to be divided
into 5 single family lots.

I. RELATIONSHIP TO THE COMPREHENSIVE PLAN:
This property lies within the "Subdivision Classification" of the
County Comprehensive Plan.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description:
The site is gently sloping and used for agricultural
purposes. There are several existing homes in the area.
B. ProjectDescription:
The applicant proposes to subdivide a 32.60 acre tract into
six parcels of 2.7, 2.6, 4.1, 4.1, and 18.4 acres each.
III. MAJOR ISSUES AND CONCERNS:
On August 8, 1983, the Board of County Commissioners approved
Resolution #83-275, approving the Laura Lee Preliminary Plan with
the following conditions:
1. A 20' easement shall be noted on the Final Plat for the
Lateral Irrigation Ditch #34 for the maintenance needs of the
ditch users.
2. A width of at least 16' for each access drive shall be noted
on the final plat and the ends of the culverts shall be encased
in concrete being a length approved by the County Road Supervisor
or extended a minimum of 3' beyond the traveled width of the
driveways. The culverts shall be a minimum of 24" in diameter.
3. The following shall be done regarding the declaration and
agreement documents for joint ownership and operation of the
wells for the Laura Lee subdivision.
a. That reference be made to the property deed book and
page number on the declaration and agreement documents;
b. That when each lot is sold, the declaration and
agreement documents must be incorporated into the deed
transfering the well rights and easements with the actual
property deed to the new owner.
4. That a 5000 gallon cistern be centrally located in the
subdivision to provide adequate fire protection to the
subdivision.
5. That the lot line between Lot #1 and Lot #2 as shown on the
Preliminary Plan be eliminated to create one 5 acre lot rather
than two 2.5 acre lots.
6. That $800.00 shall be paid to the Department of Development
to cover the School Impact Fee required by the school district.
All conditions of approval which can be met at this time have
been met.
IV. FINDINGS:
1. That the applicant has complied with all Preliminary Plan
conditions of approval prior to the Board of County Commissioners
approval.
2. That the Final Plate meets the requirements of Section 4.03
of the Garfield County Subdivision Regulations of 1979, as
amended.
V. RECOMMENDATION
The Planning Commission recommended approval on October 12, 1983.
