Dear Jason:
I am writing this letter on behalf of Colorado Rocky Mountain School ("CRMS").
CRMS is a private high school located just outside the municipal limits of Carbondale, in
Garfield County, Colorado.
There is an historic Garfield County road nght-of-way, previously known as Garfield
County Road 106, that runs through the heart of the CRMS campus. In December, 1979, the
Garfield County Commissioners closed this road to public vehicular traffic and removed it from
the County primary road system. The County did not, however, formally vacate the road.
Due to future plans to develop its campus, in the next few weeks CRMS plans to petition
the Board of County Commissioners of Garfield County to vacate that portion of County Road
106 which has been closed to the public since 1979. One of the requirements of such a petition
is that the petitioner provide the County with a letter from any mvolved utility company stating
the company's position on the proposed road vacation.
Our surveyor indicates that CenturyLink maintains an existing fiber optic line within a
portion of the roadway proposed to be vacated. I have enclosed an Exhibit Map which depicts
the portion of the road to be vacated along with the existing utility lines withm that corridor,

If the request to vacate the road is approved by Garfield County, CRMS will grant
CenturyLink a permanent, non-exclusive easement for your existing fiber optic line. It is
therefore our conclusion that the vacation of the road will not adversely affect your legal nghts to
maintain the existing fiber optic line.
I would greatly appreciate it if you could send me some form of letter or e-mail indicating
any questions or concerns that your company may have about the proposed road vacation. 1
would be happy to discuss this matter with you in more detail if you have questions.
Thank you very much for your attention to this matter.
Very truly yours,
BALCOMB & GREEN, P.C.
