Telephone (970) 945-6546 Facsimile (970) 945-8902 larry@balcombgreen.com November 12, 2013 Jay Harrington, Town Manager Town of Carbondale 511 Colorado Avenue Carbondale, CO 81623 Larry Ballenger, Public Works Director Town of Carbondale 511 Colorado Avenue Carbondale, CO 81623 Gentlemen: I am writing this letter on behalf of Colorado Rocky Mountain School ("CRMS"). As I imagine you are aware, the historic right-of-way for Garfield County Road 106 runs through the heart of the CRMS campus. In December, 1979, the Garfield County Commissioners closed this road to public vehicular traffic and removed it from the County primary road system. This road closure occurred in connection with CRMS' donation to the County of the right-of-way for what is now known as Delores Way. However, the County did not formally vacate the old 106 right-of-way at the time it acquired Delores Way. At this time, as part of its planning process, and in an effort to try to gain more certainty about where development can occur on its campus, CRMS is going to petition the Board of County Commissioners of Garfield County to vacate that portion of County Road 106 which has peen closed to the public since 1979 One of the requirements of such a petition is that the petitioner provide the County with a letter from any involved utility company stating the company's position on the proposed road vacation. I am aware that the Town maintains existing water and sewer lines within the roadway proposed to be vacated. I have enclosed an Exhibit Map prepared by Schmueser Gordon Meyer Mailing Address: P.O. Green Re: CRMS November 12, 2013 Page 2 of 2 for CRMS which depicts the portion of the road to be vacated along with the existing utility lines within that corridor. If the request to vacate the road is approved by Garfield County, CRMS will grant the Town a permanent, non-exclusive easement for its existing water and sewer lines. I therefore believe that the vacation of the road will not adversely affect the Town's legal rights to operate and maintain the existing water and sewer lines. I would greatly appreciate it if one of you could send me some form of letter or e-mail indicating any questions or concerns that the Town may have about the proposed road vacation. I would of course be happy to discuss this matter with you in more detail if you have questions. Thank you very much for your attention to this matter. Very truly yours, BALCOMB & GREEN, P.C.
