Outside grading done to where water will detour away from the building. 7. Exceptions to the outside steps, decks and grading may be made upon the demonstration of extenuation circumstances, i.e., weather, but a Certificate of Occupancy will not be issued until all the required items are completed and a final inspection made. I would bring to your attention on our Site Plan that we are proposing a 60" x 50" concrete slab for a ground -mount evaporative cooler on the west side of the home. Required sizing of the cooler slab is such that 48" of it will be within the defined net buildable area of the lot and 12" will extend over the side building setback line. Our position is this would not be considerable an encroachment as it is a piece of mechanical equipment (similar to an air conditioner condensing unit, natural gas meter or propane tank) on an uncovered slab and not a part of the home structure itself. The 12" dimension is also equal to or less than the permitted "Projections" distances identified. in Section 10.4 of the Battlement Mesa P.U.D. Zone District Regulations.
