In addition, I was present in Mr. David's home several times during the actual construction and was able to observe the modifications prior to concealement. The modifications to the garage are non-structural in nature. Specifically the garage door was in -filled using non-bearing 2X6 studs and the window opening utilized an existing headered opening. We have not verified the existing structural capacity of the garage, but nothing we observed diminished the structural integrity of the structure. 2. The exterior walls were insulated using 6" batts (R-19) with vapor barrier and the Roof structure has an assemply insulation value of approximately R-40. 3. The drywall is fastened to the studs using drywall screws at approximately 8" O.C. The ceiling drywall was existing. I hope this letter addresses the issues outstanding on Mr. David's inspection. These plans are for work which you have already done without a permit. Please be advised that it is a violation of Colorado Revised Statutes 30-28-205 & 210, Uniform Building Code, section 106.2, to construct retaining walls over four (4) feet in height without a permit. It is necessary that we receive certification from a Colorado registered professional Architect or Engineer that the retaining walls that are over four feet in height were constructed to Uniform Building Code (1997) standards. Further, with reference to my June 25, 2002 letter concerning converting your garage to habitable space without a building permit, we have not yet received certification from a Colorado registered professional Engineer or Architect that the work done was in compliance with 1997 UBC. Mr. Holiday placed a "Stop Work" order on the job on May 10, 2002, which was ignored. Subsequent to that you called me, based on Mr. Holiday's order, to discuss submitting a permit application. You committed to meet with Mr. Andy Schwaller, our Building Official, on May 17, 2002, to resolve this matter. You did not make that appointment. On June 20, 2002, I visited the property and observed work going on. There were two trucks in the front yard that were loaded with construction tools and equipment. A table saw and other tools and - equipment were set up in the front yard with cords and air hoses leading into the front door which was open. It appeared as though new doors and windows were being installed, that construction work was being performed at the rear of the house and that new flagstone patios were being constructed. I placed another "Stop Work" order at the front door and closed it. On June 21, 2002, you submitted an incomplete building permit application for converting a garage into habitable space, work which we understand, by your admission, is already completed. Neighborhood complaints allege that you are doing a whole house remodel without a building permit and without approval from the Canyon Creek Estates Homeowners Association, Architectural Review Committee. In order for us to consider an application for a building permit in Canyon Creek Estates it must be submitted to us accompanied by a letter of approval from the Architectural Review Committee, it must be complete and, in the case of a permit for work that has already been done, it must be accompanied by a letter from a Colorado Registered Professional Engineer or Architect certifying to us that the work that was done is in compliance with Uniform Building Code and National Electrical Code. It is a violation of Colorado Revised Statutes 30-28-205 & 210, Uniform Building Code and CRS 30-28-124 & 124.5, Zoning Regulations to perform construction work without a building permit and to remodel without approval of the Architectural Control Committee.
